Celem rozważań jest przedstawienie podstawowych zasad ochrony konkurencji i konsumentów oraz wskazanie najczęściej występujących nieprawidłowości na rynku usług wodociągowo-kanalizacyjnych w świetle orzecznictwa Prezesa Urzędu Ochrony Konkurencji i Konsumentów. W artykule ponadto omówiono specyfikę świadczenia usług wodociągowo-kanalizacyjnych realizowanych w warunkach monopolu naturalnego o charakterze sieciowym oraz przedstawiono podstawowe regulacje prawne w tym zakresie obowiązujące w Unii Europejskiej oraz w Polsce. Artykuł jest studium przypadku.

An aim of considerations is to present the basic principles of competition and consumer protection as well as to indicate the most often occurring irregularities in the market for waterworks and sewerage services in the light of case laws of the President of the Office of Competition and Consumer Protection. Moreover, in her article, the author discussed the specificity of rendering waterworks and sewerage services provided under the conditions of natural monopoly of the network character as well as she presented the basic legal regulations in this respect in force in the European Union and in Poland. The article is a case study.

Цель рассуждений – представить основные принципы защиты конкуренции и потребителей, а также указать чаще всего выступающие аномалии на рынке водно-канализационных услуг в свете заключений председателя Управления по защите конкуренции и потребителя (УЗКиП). Кроме того, в статье обсудили специфику предоставления водно-канализационных услуг, оказываемых в условиях естественной монополии сетевого характера, а также представили основные правовые регуляции в этом отношении, действующие в Европейском Союзе и в Польше. Статья – анализ конкретной хозяйственной проблемы.

Статья посвящена одному из видов монополии – естественной монополии. Цель статьи – раскрыть понятие и сущность естественной монополии, ее особенности и виды; выявить сферы деятельности хозяйствующих субъектов естественной монополии. Научно-практическая значимость исследования заключается в том, что полученные результаты уточняют, дополняют и развивают концептуальные положения, раскрывающие содержание естественной монополии, различных форм ее существования и деятельности. Дается определение понятию «естественная монополия», раскрывается ее сущность. Выявляются особенности и специфика естественных монополий. Дается характеристика основных признаков данного вида монополии. Подчеркивается, что особенностью естественных монополий является существование очень высоких входных барьеров в отрасль. Выявляются причины возникновения и существования естественной монополии. Естественные монополии возникают там, где конкуренция невозможна или экономически нецелесообразна, то есть там, где конкуренция менее эффективно использует ресурсы общества. Рассматриваются и анализируются два основных типа естественных монополий: природная монополия, которая возникла в результате наличия уникальных природных явлений (климат, природные ископаемые, редкость определенного сырья, расположение); технико-экономические монополии, возникновение которых продиктовано либо техническими, либо экономическими причинами, связанными с проявлением эффекта масштаба. Выявляются положительные и отрицательные свойства естественной монополии, ее плюсы и минусы. Раскрываются законодательно установленные обязанности субъектов естественных монополий. Делается вывод, что естественные монополии опираются либо на уникальные природные ресурсы, либо на уникальную сложную технологию; что у естественной монополии достоинства становятся недостатками и наоборот. Эта форма экономической организации глубоко противоречива. Невозможно однозначно определить, что перевешивает – плюсы или минусы. Выводы и предложения носят целенаправленный характер в условиях рыночной экономики и позволяют совершенствовать регулирование естественных монополий стран – членов ЕАЭС.

The article is devoted to one of the kinds of monopoly — a natural monopoly. The purpose of the article is to reveal the concept and essence of natural monopoly, its peculiarities and kinds, to identify areas of economic activity in the sphere of natural monopoly. Scientific and practical significance of the research is that the results clarify, supplement and develop conceptual provisions that reveal the content of natural monopoly, various forms of its existence and activity. The definition of the concept "natural monopoly" is given; its essence is revealed. The peculiarities and the specificity of natural monopolies are described. The characteristic of the main features of this kind of a monopoly is given. It is emphasized that one of the peculiarities of natural monopolies is the existence of very high barriers to entry into the industry. The reasons of the emergence and existence of a natural monopoly are revealed. Natural monopolies occur where the competition is impossible or economically inexpedient, that is, where the competition uses the resources of the society less efficiently. Two main types of natural monopolies are considered and analyzed: a) a natural monopoly that has arisen as a result of the presence of unique natural phenomena (climate, natural resources, the rarity of certain raw materials, location); b) the technical and economic monopoly, the occurrence of which is dictated either by technical or economic reasons related to the manifestation of scale. The positive and negative characteristics of a natural monopoly, its pros and cons are identified. The legal duties of subjects of natural monopolies are disclosed. It is concluded that natural monopolies are based either on the unique natural resources or unique complicated technology; that the advantages of natural monopoly can become disadvantages, and vice versa. This form of economic organization is deeply controversial. It is impossible to determine clearly what is prevailing – pluses or minuses.
