The article concerns the legal nature of the Polish judge – commissioner in account with the bankruptcy proceedings by liquidation of the bankrupt’s assets. It approaches the nature of the competences of the judge – commissioner and presents them as compulsory or optional. The authoress tries also to explain the importance of the judge – commissioner decisions.

Статья посвящена проблеме правового характера судьи - комиссара в польской процедуре банкротства с ликвидацией. Освещает также вопрос о компетенции судьи, вводя одновременное распределение задач на обязательные и факультативные. Через призму этого анализа, автор пытается показать, как важна правильность решений (формальных и существенных) судьи - комиссара в соответствующих процедурах банкротства, особенно в случаи ликвидации.
