Bez wątpienia problemy prawne często dotykają polskich przedsiębiorców. Naruszenie przepisów prawnych przez przedsiębiorców rozpoczynających działalność gospodarczą wydaje się zjawiskiem dość powszechnym. Chcąc ułatwić prowadzenie działalności gospodarczej, wprowadzono do ustawy z dnia 6 marca 2018 roku Prawo przedsiębiorców nową instytucję prawną zwaną „prawem do popełnienia błędu”. W świetle regulacji art. 21a Prawa przedsiębiorców, która weszła w życie 1 stycznia 2020 roku, z prawa tego mogą korzystać wyłącznie przedsiębiorcy będący osobami fizycznymi, którzy działają na podstawie wpisu do Centralnej Ewidencji i Informacji o Działalności Gospodarczej i którzy dopiero rozpoczynają działalność gospodarczą po raz pierwszy lub którzy wznowili działalność gospodarczą po upływie 3 lat od jej zawieszenia lub zakończenia. Przedmiotem artykułu są rozważania nad istotą „prawa do popełnienia błędu”, które stanowi formę tak zwanego samooczyszczenia początkującego przedsiębiorcy.

Indubitably, Polish entrepreneurs often face legal difficulties. It seems that violation of legal provisions by entrepreneurs who are starting business activity is a widespread phenomenon. In order to make doing business easier, a new provision was introduced to the Act from 6.03.2018 Entrepreneurs’ Law, the so-called “the right to make a mistake”. In the light of the new legislation, article 21a of the Entrepreneurs’ Law, that came into force on 1st January 2020, only natural persons conducting business activities registered in the Central Registration and Information on Business and are beginning or resuming business activities after 3 years of suspension or ceasing their business activities, are entitled to this right. The subject of this article is a consideration of the essence of “the right to make a mistake” by entrepreneurs, which in fact is a method of „self-cleaning”.
