Po zmianach ustawy o związkach zawodowych sytuacja procesowa osoby świadczącej pracę zarobkową na innej podstawie niż umowa o pracę powinna być przeanalizowana, ponieważ jest to kwestia zupełnie nieopisana w doktrynie. Z punktu widzenia konstytucyjnej zasady równości należy postawić tezę o równym traktowaniu osób zatrudnionych bez względu na stosunek prawny łączący podmiot wykonujący i oferujący pracę. W związku z powyższym powinno się stosować w sposób odpowiedni przepisy kodeksu postępowania cywilnego dotyczące pracowników. Niemniej ustawa nie reguluje tej kwestii, a ustawodawca nie wskazuje sposobu na rozwiązanie tego problemu. Jedynie za pomocą stosownej wykładni norm możliwe jest ich zastosowanie zgodnie z fundamentalnymi zasadami porządku prawnego. De lege ferenda powinno się postulować dodanie przepisu do ustawy o związkach zawodowych, który pozwalałby na odpowiednie stosowanie procedury cywilnej w zakresie spraw pracowniczych do osób świadczących pracę zarobkową na innej podstawie niż stosunek pracy.

After the amendment of the Trade Unions Act, the procedural situation of persons providing paid work on a different basis than the employment relationship should be analyzed. From the point of view of the constitutional principle of equality, the procedural position of an employee and a person providing providing paid work on a basis other than the employment relationship can not be differentiated. Therefore, for these entities shall use the same procedural provisions. De lege ferenda the legislator should make a clear reference to the provisions of the Labor Code.
