The Treaty of Lisbon has introduced some major structural changes within the European Union, one of which was the abolition of its traditional legal architecture: the three-pillar structure. In the first part of the article, the author presents the issue of the Court of Justice’s jurisdiction in the former third pillar and highlights its significant limitations. In this context, the provisions of the Treaty of Amsterdam on the Area of Freedom, Security and Justice (AFSJ) are analyzed. Secondly, the author emphasizes that, in the light of the Treaty of Lisbon, the AFSJ is realized through a variety of European Union instruments. As the jurisdiction of the Court of Justice covers all EU law, cooperation within the AFSJ falls under its competence. Finally, the author underlines some exceptions to this rule.

Tragedia, która miała miejsce na początku października 2013 r. u wybrzeży Lampeduzy, zwróciła oczy całego świata na problem nielegalnej imigracji do Unii Europejskiej, ale także na katastrofalną sytuację w państwach pochodzenia imigrantów. W związku z tym wydarzeniem, jak i trudną sytuacją migracyjną w Europie powstałą jeszcze w 2011 r. w wyniku wybuchu Arabskiej Wiosny, rządy państw członkowskich Unii Europejskiej zdecydowały o kompleksowym podejściu do zjawiska nieuregulowanej imigracji celem ustanowienia najskuteczniejszych metod jej zwalczania. W tym celu powstało szereg instrumentów legislacyjnych i politycznych stanowiących zestaw działań stanowiących odpowiedź na presję migracyjną na granice zewnętrzne UE. Z uwagi na niezakończony konflikt w Syrii, początek walk w środkowej Afryce, a także niespokojną sytuację na Ukrainie można mieć pewność, że ich skuteczność będzie stale poddawana próbie.

The tragedy that took place in October 2013 at the shores of Lampedusa island drew attention of the world to the issue of immigration to the EU, but also to a catastrophic situation in the countries of origin of the irregular immigrants. Due to the above-mentioned event, as well as particularly difficult migration situation in Europe that takes its origins in the Arab Spring of 2011, the governments of the EU Member States decided to employ a complex approach to the problem of irregular immigration in order to adopt the most effectives ways to deal with this issue. Within that framework, a series of legislative and political instruments were established that constitute a set of actions seen as an adequate response to the migratory pressures on the EU external frontiers. The continuous conflict in Syria, the outbreak of fights in Central Africa, as well as the turmoil in Ukraine, provide a certainty that the effectiveness of the European measures will be constantly tested.
