The subject of this research is the concept of sobornost in the philosophy of Nikolai Berdyaev. On the basis of the dialectical method, such stages of the development of sobornost are distinguished as being, essence, and concept. The actualization of sobornost arises in the church community, the secular community, the church-secular community. The thesis in the formation of the category of sobornost at the level of its beingness is the church community in the maxims of salvation. The essential stage in the formation of sobornost is the secular community, where sobornost is revealed as a collection, collectivity. Ideas of creativity are develop, and a split and disunity are characteristic. The resolution of the Divine Trinity, human and cosmic community in freedom and love – this is the state of the conceptual level of sobornost in the church-secular community, where salvation and creativity are united. It can be concluded that sobornost is present in all designated types of community, being in dialectical development.

The starting point of the following considerations is the assumption that philosophical communitarian discourse as well as the juridical discourse about communitarian rights represent two sides of the same phenomenon. When the European Union was founded, the ideological basis of the liberal democracies, concerning human and individual rights, seemed to be insufficient. Therefore we need to return to the communitarian elements of culture and tradition that will ensure real autonomy.

In 1890, Vincent van Gogh moved from Paris to Auvers-sur-Oise, where he met Dr. Paul-Ferdinand Gachet, who agreed to host and take care of the painter, especially regarding his mental health. However, he did not manage to save the artist, who committed suicide the same year. His hopeless mental health was seen in the famous portrait of Dr. Gachet, which radiated a distinct melancholy and sadness. The Portrait of Dr. Gachet was bought for $ 82.5 million by a Japanese millionaire and art collector, Ryoei Saito, who said that after his death it was to be burned along with his corpse. It raised loud objections in the art world, which recognised the common good and the legacy of our cultural heritage in the painting. This case is a classic example of a dispute between the ideals of liberalism and communitarianism and is seen as a hard case in law. The aim of the article is to present the history of The Portrait of Dr. Gachet and its place in the dispute between liberalism and communitarianism (in the context of cultural heritage law), which in turn means that this case can be seen as a hard case.

Punktem wyjścia dla analizy jest dwuznaczność pojęcia wspólnota, mającego pozytywne, jak i negatywne konotacje. Zasadnicze pytanie, na które próbuje się odpowiedzieć w artykule, dotyczy możliwości stworzenia wspólnoty odpowiadającej wymogom nowoczesności – w przeciwieństwie do tradycyjnej, Toennisowskiej Gemeinschaft. Koncepcja zmodernizo- wanej „wspólnoty wrażliwej” zaprezentowana jest w ramach jednego ze współczesnych podejść teoretycznych: komunitaryzmu. W artykule dowodzi się, że „unowocześniona” wizja wspólnoty, jaką przedstawiają komunitarianie, ma szansę realizacji w dobie społeczeństwa nowoczesnego czy ponowoczesnego.

The starting point for the analysis is the ambiguity of the term 'community', which has both negative and positive connotations. The basic problem the article addresses refers to the possibility to create a community which would meet the requirements of modernity - in contrast to the traditional notion of Gemeinschaft created by Ferdinand Toennies. The concept of modernized 'responsive community' is presented within the framework of one of the contemporary theoretical approaches: communitarianism. The author proves that the 'modernized' vision of community described and explored by communitarian thinkers has a certain chance to be put into practice in the era of modern and post-modern society.
