In 2020, we celebrate the 25th anniversary of the Committee of the Regions - the representative body of the European Union's local and regional authorities. Its main goal was to represent the interests of local governments at the level of this international organization, to increase the democratic mandate of the European Union, as well as to increase the transparency of public debate between European institutions.A quarter of a century is a good time to try to evaluate the actions taken by this body of the European Union. The purpose of this article is to conduct a legal analysis of the evolution of primary law of the European Union in the functioning of this body, to summarize the functioning of this body, as well as its impact on the legislative process of the European Union. The article will also present a proposal for the development direction of this body in the coming years.

The Polish Constitution does not provide for the existence of regional parliaments with legislative competences in Poland. The chambers of the Polish Parliament are therefore not obliged to hold consultations under Article 6 of the Protocol on the Application of the Principles of Subsidiarity and Proportionality. However, members of self-governing representative bodies are members of the EU’s Committee of the Regions, which can bring an action before the Court of Justice of the EU for violation of the principle of subsidiarity by an EU act and can also take a position on the compliance of EU action with the principle of subsidiarity as an advisory body.

W artykule rozważam funkcje spełniane przez Komitet Regionów w procesie legislacyjnym Unii Europejskiej oraz w polityce unijnej i krajów członkowskich. Główna teza analiz opartych na metodzie dedukcji, koncentruje się wokół założenia, że w aktualnej sytuacji politycznej w Europie Komitet Regionów ma do odegrania nie tylko rolę opiniodawczą w obszarze legislacji, lecz także szerszą, fundamentalną rolę w kształtowaniu przyszłych kierunków rozwoju całej Unii Europejskiej. Rozważania prowadzone są w kontekście teorii federalizmu fiskalnego – w szczególności jednego z jej elementów, opartego na założeniu znaczenia struktury federalnej w łagodzeniu konfliktów – i w kontekście hybrydowego charakteru współczesnych modeli rozwoju. Wykorzystano w nich literaturę przedmiotu, opracowania na zlecenie Komisji Europejskiej, materiały Komitetu Regionów, dotychczasowe wyniki badań i tzw. raporty wpływu Komitetu Regionów opublikowane w latach 2014–2017.

The article discusses the functions of the Committee of the Regions with respect to the legislative process and politics of the European Union, as well as to the politics of the Member States. The main assumption of the analysis, based on the deductive method, is that because of the current political situation in Europe, in addition to being a body giving opinions on the law, the Committee of the Regions should have a greater, fundamental role in shaping the future directions of development for the entire European Union. The discussion is set in the context of fiscal federalism theory and one of its elements assuming that a federal structure has a role in mitigating conflicts, as well as referring to the hybrid nature of the contemporary models of development. It is underpinned by the relevant literature, analyses commissioned by the European Commission, materials of the Committee of the Regions, findings of earlier studies, and the so-called impact reports of the Committee of the Regions published from 2014 to 2017.

Celem niniejszego artykułu jest analiza konsekwencji konstrukcji mandatu członka Europejskiego Komitetu Regionów. Aby nim zostać, należy sprawować demokratyczny mandat na poziomie lokalnym lub regionalnym. Taki stan rzeczy powinien prowadzić to zmniejszenia dystansu między Unią Europejską a jej obywatelami, a tym samym do zmniejszenia deficytu demokratycznego. Zależy to jednak od rzeczywistego modelu funkcjonowania Europejskiego Komitetu Regionów. W praktyce można go określić bardziej jako technokratyczny, aniżeli demokratyczny, co jest istotnym paradoksem. Zaprezentowane wnioski oparte są na badaniu empirycznym Autora.

The aim of the present paper is to analyse the consequences of the construction of membership in the European Committee of the Regions. To be a member of this body, one must have a democratic mandate at a local or regional level. This should bring the citizens closer to the European Union and therefore, reduce the democratic deficit. However, it all depends on the actual model of the functioning of the European Committee of the Regions. In practice, it can be described as technocratic rather democratic, which is a great paradox. Such a conclusion has been drawn on the basis of the author’s own empirical research.
