On 01/01/2019, the obligation to report tax schemes was introduced. The material scope of Polish regulations is much wider than that of the EU regulations, covering, in addition to cross-border tax schemes, also their domestic counterparts. In connection with the obligation to report tax schemes, a glossary of terms related to these schemes was introduced to the Tax Ordinance Act. The article describes the interpretation possibilities of the term „promoter”, which is obliged to report tax schemes to the Head of KAS. The publication puts forward the thesis, according to which the formal and functional definition of the term „promoter” is too broad and the inability to obtain an individual interpretation concerning this definition resulted in the submission of an excessive number of tax schemes.

W dniu 1 stycznia 2019 r. wprowadzono obowiązek raportowania schematów podatkowych1. Zakres przedmiotowy polskich regulacji jest znacznie szerszy niż unijnych, gdyż obejmuje – oprócz transgranicznych schematów podatkowych – również ich krajowe odpowiedniki. W związku z obowiązkiem raportowania schematów podatkowych wprowadzono do Ordynacji podatkowej słowniczek terminów powiązanych z tym zagadnieniem. Obowiązek raportowania schematów podatkowych Szefowi Krajowej Administracji Skarbowej2 ciąży na promotorze. W artykule opisano, w jaki sposób można interpretować termin „promotor”, jak również postawiono tezę, że jego zbyt szeroka definicja pod względem formalnym i funkcjonalnym oraz brak możliwości uzyskania interpretacji indywidualnej dotyczącej tej definicji spowodowały składanie nadmiernej liczby informacji o schematach podatkowych.
