Ubezwłasnowolnienie jest istotnym ograniczeniem praw i wolności osobistych człowieka. Najpoważniejsze skutki ubezwłasnowolnienia polegają na utracie lub ograniczeniu zdolności do czynności prawnych osoby ubezwłasnowolnionej. Europejski Trybunał Praw Człowieka dotychczas nie orzekł o sprzeczności instytucji ubezwłasnowolnienia z Konwencją o ochronie praw człowieka i podstawowych wolności. Jednak stosowanie ubezwłasnowolnienia jest w orzecznictwie ETPC dopuszczalne jedynie w wyjątkowych sytuacjach. ETPC wskazał podstawowe wymagania, jakie musi spełniać ta instytucja, aby była zgodna ze standardem konwencyjnym.

Incapacitation is a significant limitation of human rights and personal freedoms. The most serious consequences of legal incapacitation consist in loss or limitation of legal capacity of a legally incapacitated person. The European Court of Human Rights has not yet ruled on the contradiction of the institution of incapacitation with the Convention for the Protection of Human Rights and Fundamental Freedoms. However, the use of incapacitation is only allowed in ECHR jurisprudence in exceptional situations. The ECtHR has pointed out the basic requirements that this institution must meet in order to comply with the convention standard.

The article provides an analysis of judgment of Grand Chamber of the European Court of Human Rights of 7 July 2011 in the case of Bayatyan v. Armenia, in which the Court, based on the “living instrument” doctrine, gives — inter alia — a new creative interpretation of Article 9 of the Convention. In this interpretation the Court broadened its scope of protection to include conscientious objectors, to autonomous extent, within the full meaning of this prerequisite not functionally limited to matters relating to the armed service, which might be indicated by the scope of the case considered.
