The article is devoted to regulations concerning adoption, written in the so-called Code of Gortyn, founded in the first half of the 5th century BC. First, the author made a translation of a fragment of the Code which contained provisions relating to adoption. Then, he discussed the terminology for the institution and the qualifications the adopters and adoptees needed to meet. The rest of the article deals with the form of adoption, the legal consequences of this act, cancellation of the act and the confirmation of property rights acquired by the adoptee prior to the announcement of the Code. Wherever possible, the author showed differences and similarities between the Code of Gortyn and Athenian regulations. In the conclusion, he stressed that the position of an adopted son was not as strong as the position of the sons born in wedlock. He was not, in contrast to the former, made heir to his parents’ properties. He also did not have as strong a position as an adopted son in Athens. Athenian law did not diversify the situation of children born in wedlock (gnesioi) and those adopted. They both inherited the same part of the property. In Gortyn the adoptee who had adoptive brothers and sisters inherited equally with the latter, hence half of the property was inherited by a legitimate son.

The form of matrimonial property regime enshrined in the Code is the regime of separate property. The code frequently mentions separation of property of the husband and the wife, providing detailed rules of inheritance. Goods belonging to a woman passed to her heirs after her death. The property was divided also in the case of divorce. The article deals with divorce and the legal consequences of the dissolution of marriage as defined in the Gortyn Code. The author examines the issue of divorce initiative, blame for the break-up of marriage, rules of property distribution and penalties for the seizure of the husband’s goods by the wife. In addition, the author discusses the situation of children after their parents’ divorce.

The article is devoted to the history of the discovery of the so-called Code of Gortyn, which has attracted the interest of philologists and historians of law. The Code of Gortyn was discovered in the late 19th century by chance, yet the discovery was linked to large-scale archaeological research conducted on the island by the French, Germans and Italians. Its most extensive fragment was found by the Italian scholar Frederico Halbherr, who is consequently regarded as its discoverer, although we should not forget about the contributions of French scholars working independently, about the assistance provided by Ernst Fabricius and about the contributions of local scholars.

Gegenstand des Beitrags ist die Geschichte der Entdeckung des sog. Stadtrechtes von Gortys, das seitdem Gegenstand der Interesse der Philologen und Rechtshistoriker ist. Die Entdeckung der Inschrift am Ende des 19. Jahrhunderts in Gortys war ein reiner Zufall, obwohl sie doch mit den breit angelegten archäologischen Untersuchungen, die auf Kreta durch die Franzosen, Deutschen und Italiener geführt waren, im Zusammenhang stand. Der größte Teil der Inschrift wurde durch den italienischen Wissenschaftler Frederico Halbherr gefunden, so gilt er als ihr Entdecker. Der Beitrag der französischen Wissenschaftler, die unabhängig handelten, sowie die Hilfe seitens Ernst Fabricius und auch der Beitrag des örtlichen wissenschaftlichen Milieus dürfen jedoch dabei nicht vergessen werden.
