The article is a brief summary of the Hegelian concept of the private sphere, especially focused on the problems of sex, gender, kinship and law. The problems signalized in the title of the article lead to a wider discussion between sometimes-contradictory interpretations of the Antigone's Claim and of Hegel's philosophy in general. The discussion between various interpretations of the 'Phänomenologie des Geistes', especially those which lead to an analysis of the contemporary democracy in the notions proposed by Hegel, namely those by M. J. Siemek, J. Butler, C. Pateman and J. Gauthier, shows the actuality of Hegelian thought. The questions of gender, family and kinship can be analyzed in their social context.
