In the Digital age, when the main focus of the society is on the issue of transferring pieces of works by electronic meansand at the same time infringing intellectual property rights (IPR), it is worth to remember how important role the customs law playsfor the import of material carriers. Customs services are authorized to detain goods suspected of infringing intellectual propertyrights which are covered on the basis of issued decisions as well as ex officio in the situation when the application has not beensubmitted by the right holder and a serious suspicion of goods infringing intellectual property rights exists. The priority in this caseis fighting against counterfeit and pirated goods. The discussed issue is governed by the provisions of national and European customslaw. The recent EU regulation on the enforcement of intellectual property rights by customs services extend the range of possibilitiesgiven in the procedures concerning destruction of goods infringing intellectual property rights. The main problem with this issueis to find balance between reasonable enforcement of these procedures and excessive use of control procedures that may affectinterests of entrepreneurs e.g. the continued detention of goods intended for export. The following paper is an attempt to bring upthe most important issues connected with this rather rarely discussed subject. The article concerns the provisions of Customs Law,Copyright Law and derivative rights as well Industrial Property Rights. The issue of customs law with respect to intellectual propertyrights is still too rarely discussed by the lawyers and it should be taken into consideration especially due to the dynamic changestaking place in the cross‑bordertrade policies of the EU and its eastern neighbours.

In the article the author discusses the nature and features of committing the considered type of crime on the basis of the available specificities of intellectual property counterfeiting in the Republic of Kazakhstan. Investigation into the systematic violation of intellectual property rights of citizens encounters a lot of difficulties, therefore it is no accident that the author proposed an algorithm for using the knowledge about the mechanism of intellectual property counterfeiting in the detection and investigation of that type of crime. The author conducted an analytical debate in determining the place and importance of the method and mechanism of committing fraud in the elemental system of forensic crime characteristics where the specified totalities are integrated into a specific (key) category. Thus, it is the use of specialized scientific knowledge that makes it possible to determine the step-by-step mechanism of committing fraudulent acts by a malefactor leading to external or substantial similarity between fakes and an original prototype. Also the article presents statistical indicators reflecting the dynamics and other quantitative data connected with the procedure of crime investigation in the sphere of intellectual property counterfeiting. In conclusion, the author of the article gives practical recommendations aimed at optimizing the process of detection and investigation of crimes related to counterfeiting intellectual property. In particular, at the stage of creation or mass production of considered material objects it is highly recommended that advanced technologies are used in order to impede counterfeiting to the maximum (three-dimensional holography, watermarking, cryptography, etc.).

Z przeprowadzonej diagnozy stanu wynika, że kobiety stanowią znaczną mniejszość w grupie osób zgłaszających i w konsekwencji uzyskujących patenty. Rozwój nowoczesnych technologii przynosi nowe możliwości dla kobiet, które z powodu ograniczonego czasu i braku dedykowanego profesjonalnego doradztwa mniej aktywnie uczestniczą w składaniu wniosków patentowych na rzecz rozwoju przemysłu. Zaprezentowane w artykule studium przypadku międzynarodowego projektu ip4Women pokazuje, że odpowiednio zaprojektowane szkolenie e-learning dopasowane do potrzeb grupy docelowej oraz świadczenie usług e-mentoringu poprzez specjalnie zaprojektowaną platformę internetową stanowią szansę dla kobiet na aktywne uczestnictwo w składaniu wniosków patentowych i rozwiązań dla przemysłu poprzez doskonalenie kompetencji zawodowych w tym obszarze. Prezentowane wyniki międzynarodowych badań zostały uzyskane w ramach projektu ip4Women, program Erasmus+. Tematyka badawcza wpisuje się jednocześnie w inicjatywę UNESCO, ONZ – Women oraz World Intellectual Property Organization WIPO pod hasłem: „Science – Innovation – Entrepreneurship: Closing the Gender Gap to Meet the SDGs” / „Nauka – Innowacja – Przedsiębiorczość: Zmniejszenie nierówności płciowej na drodze do osiągnięcia Celów Zrównoważonego Rozwoju”.
