Współcześnie życie gospodarcze koncentruje się niejednokrotnie na działalności za pośrednictwem sieci internet, w ramach której występuje coraz więcej nowych, specyficznych przejawów nieuczciwej konkurencji. Problematyczne staje się przy tym zagadnienie granic swobody wyboru nazwy domeny inter-netowej oraz jej wykorzystania w adresach internetowych. Na liczbę występujących nadużyć – m.in. wykorzystywania cudzej renomy, marki, znaku towarowego – wpływ ma brak jednoznacznych przepisów odnoszących się bezpośrednio do nieuczciwego obrotu w internecie. Zastanowić się należy nad możliwością wykorzystania m. in. norm prawa zwalczania nieuczciwej konkurencji w sporach dotyczących branży e-commerce. Niniejszy artykuł ma zaś na celu ocenę efektywności wykorzystania istniejących instrumentów prawnych do ochrony przed różnego rodzaju nieuczciwymi zacho-waniami w internecie.

The Internet is now an indispensable part of social as well as economic life around the world. As a relatively new place of entrepreneur’s activity, the Internet may also be a place of various types of law malfeasance. On the Internet, there are also more and more new, specific kinds of indications of unfair competition. The fundamental problem, which meets at that prevention practices, is the fact that in relation to unfair online trading there are no separate regulations. This article aims to provide the sample characteristic of the Internet environmental practices, which can be regarded as acts of predatory competition and ways of its legal interpretation. The analysis refers to the issue of encounter between unfair competition norms and the new methods of its practice - the main objective is to assess whether the existing legal standards are an adequate legal framework to protect against this type of fraudulent behavior on the Internet.
