The subject of this study is rooted in the realities of Poland of the authoritarian period. This fact has been emphasized in the title and considered a circumstance that defines the direction and scope of the research activities. The article is divided into three essential parts. The first one points to basic facts related to the status of courts of law in the authoritarian Poland. The broad definition of the title concept was adopted. Certainty is understood here as tantamount to stability of judicial service employment relationship and covers both irremovability, non-transferability and non-suspension, as well as predictability and transparency of promotions and service conditions, especially in terms of determining salaries. The second part of the article provides an analysis of the constitutional regulation of certainty of the position. The third part comprises remarks on the actual role of the Constitution, it covers findings on the manner in which the title institution was regulated in lower-tier normative acts and remarks on the practice of application of law. The research leads to the conclusion that certainty of judge’s position was illusory. It was being questioned at all the three interrelated levels: constitutional, regular legislation and the practice of law application.

Rozważania w niniejszym artykule zostały osadzone w rzeczywistości autorytarnej Polski. Fakt ten podkreślono w tytule i uznano za okoliczność determinującą kierunek i zakres czynności badawczych. Artykuł podzielono na trzy zasadnicze części. W ramach pierwszej przypomniano o podstawowych faktach wiążących się ze statusem sądów w autorytarnej Polsce. Przyjęto szerokie rozumienie tytułowego pojęcia. Pewność jest w tym wypadku tożsama ze stabilnością stosunku służbowego i obejmuje nie tylko nieusuwalność, nieprzenaszalność i niezawieszalność, lecz także przewidywalność i transparentność awansów oraz warunków służby, zwłaszcza w zakresie kształtowania uposażeń. W drugiej części opracowania przeprowadzono analizę konstytucyjnej regulacji pewności stanowiska. Część trzecia zawiera uwagi o faktycznej roli konstytucji; obejmuje ona ustalenia mające za przedmiot sposób, w jaki uregulowano tytułową instytucję w aktach normatywnych niższego rzędu oraz uwagi o praktyce stosowania prawa. Badania prowadzą do wniosku, że pewność sędziowskiego stanowiska była iluzoryczna. Podważano ją konsekwentnie we wszystkich trzech sprzężonych ze sobą poziomach: konstytucyjnym, ustawodawstwa zwykłego i praktyki stosowania prawa.

The subject matter of this article is discussing legal concepts of Ignacy Matuszewski in the interwar period. In the core of the camp of adherents of Piłsudski he was one of the few people interested in the economic issues of the state, what is more he belonged to a small circle of its representatives who themselves formulated original political concepts of the Republic of Poland. Matuszewski’s output as a publicist formed not only the projects of a constitution, but also discussions concerning the shape and functioning of specific constitutional bodies. It was demonstrated that Matuszewski – the proponent of strong power of the head of the state, at the same time was characterised by a pragmatic attitude to system issues. He was against the view that only with the help of adequately enacted law the intended goal could be unfailingly achieved. The article contains the analysis of Matuszewski’s constitutional views from which it could be deduced that he was the advocate of a two-chamber parliament and of effective rule of the Council of Ministers. The study brings closer the achievements of Matuszewski in the sphere of law, which are in our times practically unknown.
