Unter den Rechtsquellen des Herzogtums Warschau spielten die in der Re- publik Polen vor den Teilungen geltenden Gesetze und Gebräuche eine bedeutende Rolle. Die in „Dziennik Wyroków Sądu Kasacyjnego Księstwa Warszawskiego“ [„Gerichtsblatt des Kassati- onsgerichtshofs des Herzogtums Warschau“] veröffentlichten Urteile sind insofern wichtig, als sie einen Einblick in die damaligen Praktiken der Gerichtsbarkeit sowie in die Quellen des ma- teriellen und prozessualen Rechts gewähren. Die Analyse der Urteile des Kassationsgerichtshofs des Herzogtums Warschau lässt schlussfolgern, dass sich diese Instanz nur selten auf das Recht aus der Zeit vor den Teilungen stützte.

Among the sources of law in the Duchy of Warsaw, the rules and customs in force in the Republic before its collapse played a significant role. The judgments published in the "Journal of Judgments of the Court of Cassation of the Duchy of Warsaw" are vital for understanding the judiciary practice, as well as for the sources of substantive and procedural law of that time. The analysis of judgments of the Court of Cassation of the Duchy of Warsaw shows that this court rarely relied on pre-partition law.

Wśród źródeł prawa Księstwa Warszawskiego znaczący udział miały przepisy i zwyczaje obowiązujące w Rzeczypospolitej przed jej upadkiem. Orzeczenia opublikowane w Dzienniku Wyroków Sądu Kasacyjnego Księstwa Warszawskiego są istotne dla poznania praktyki wymiaru sprawiedliwości a także dla źródeł ówczesnego prawa materialnego i procesowego. Analiza wyroków Sądu Kasacyjnego Księstwa Warszawskiego pozwala na stwierdzenie, że organ ten rzadko opierał się na prawie przedrozbiorowym.
