Background: Competition in the banking industry has been an important topic in the scientific literature as researchers tried to assess the level of competition in the banking sector. Objectives: This paper has an aim to investigate the market structure and a long term equilibrium of the banking market in Bosnia and Herzegovina nationwide as well as on its constitutional entities as well as to evaluate the monopoly power of banks during the years 2008-2012. Methods/Approach: The paper is examining the market structure using the most frequently applied measures of concentration k-bank concentration ratio (CRk) and Herfindahl-Hirschman Index (HHI) as well as evaluating the monopoly power of banks by employing Panzar-Rosse “H-statistic”. Results: The empirical results using CRk and HHI show that Bosnia and Herzegovina banking market has a moderately concentrated market with a concentration decreasing trend. The Panzar-Rosse “H-statistic” suggests that banks in Bosnia and Herzegovina operate under monopoly or monopolistic competition depending on the market segment. Conclusions: Banks operating on the banking market in Bosnia and Herzegovina seem to be earning their total and interest revenues under monopoly or perfectly collusive oligopoly.

Jeżeli zasoby nie są alokowane, a produkty dystrybuowane za pośrednictwem systemu rynkowego, funkcje alokacyjne i dystrybucyjne musi przejąć bezpośrednio agencja polityczno-biurokratyczna. W tym bezpośrednim i oczywistym sensie rynki, na tyle, na ile mogą samodzielnie działać, ograniczają biurokratyczną interwencję w życie obywateli. Porządek rynkowy minimalizuje zakres biurokratycznej uznaniowości, ale funkcjonuje on tylko w ramach konstytucyjnych, które muszą jednak zostać zaprojektowane i utrzymane politycznie. Głównym celem artykułu jest wykazanie, że w myśl poglądów Jamesa Buchanana gospodarka organizowana na zasadach rynkowych skutecznie minimalizuje zakres biurokratycznej uznaniowości, a więc liczbę decyzji ekonomicznych, które muszą być podejmowane w wymiarze politycznym, tzn. za pośrednictwem agencji działającej w imieniu rządu.

If resources are not allocated, and products distributed via the market system, the allocation and distribution functions must be performed directly by the political and bureaucratic agency. In this direct and obvious sense, markets, as far as they can act independently, limit bureaucratic intervention in the lives of citizens. The market order minimizes the scope of bureaucratic discretion, but this order functions only within a constitutional framework, which must, however, be designed and maintained politically. The main goal of the article is to show that an economy that is organized on market terms effectively minimizes the scope of bureaucratic discretion, and hence the number of economic decisions that must be made politically, that is, through an agency that acts on behalf of the government.

The society is a complex formation consisting of relations, impacts and roles. The need of satisfying the needs was embedded into the society as a mechanism providing the coherence. The democracy acting on the basis of the abstract rule of equality before the law, requires the usage of different mechanisms which guarantee the continuity of the law system. As the bureaucracy became a part of the social organism functioning within the capitalistic and democratic conditions, it enabled the change of the community actions into rational and regular ones.
