The article concerns the application of the prerogative of mercy in the territories of the former Prussian Partition when the Chief of State Józef Piłsudski was the head of state. It portrays the manner in which the Civil Chancellery of the Chief of State applied the law in the territories of the former Prussian Partition. Moreover, it presents statistical data pertaining to the following issues: crimes, legal systems, and decisions made by the Chief of State.

Artykuł dotyczy stosowania prawa łaski na terenie byłego zaboru pruskiego w okresie, gdy głową państwa był Naczelnik Państwa Józef Piłsudski. Ukazano w nim sposób, w jaki Kancelaria Cywilna Naczelnika Państwa stosowała prawo na terenie byłego zaboru pruskiego, oraz przedstawiono dane statystyczne odnoszące się do problematyki przestępstw, systemów prawnych i decyzji podjętych przez Naczelnika Państwa.

The purpose of the present article is to delineate the legal aspects of the formation of the special judiciary created by the Minister of the former Prussian District on the lands of the former Prussian District in 1920. The article presents the position of the Minister of the former Prussian District in the sphere of public safety in the lands of the former Prussian District, the powers of the Minister of the former Prussian District connected with the state of siege and the state of emergency in the lands of the former Prussian District as well as the provisions of the criminal law and of the criminal procedure applied in Provisional Courts, court-martials, and in the proceedings of the Summary Court of 26 April 1920, which were formed in the former Prussian District. The article is based on such sources as the Official Journal of the Ministry of the former Prussian District, Official Weekly / Supreme People’s Council Weekly, acts of law of the Prussian and German states as well as the materialswhich can be found in the Military Historical Office in Warsaw (formerly known as the Central Military Archives in Warsaw) and the State Archive in Poznań.

Celem artykułu jest przedstawienie aspektów prawnych tworzenia się sądownictwa specjalnego powołanego przez ministra byłej dzielnicy pruskiej na terenie byłej dzielnicy pruskiej w 1920 roku. W artykule przedstawiona zostanie pozycja ministra byłej dzielnicy pruskiej w sferze bezpieczeństwa publicznego na terenie byłej dzielnicy pruskiej, uprawnienia ministra byłej dzielnicy pruskiej związane ze stanem oblężenia i stanem wyjątkowym na terenie byłej dzielnicy pruskiej oraz przepisy prawa karnego i karnego procesowego stosowanych w sądach tymczasowych, sądach polowych oraz w sądzie doraźnym z dnia 26 kwietnia 1920 r. powołanych na terenie byłej dzielnicy pruskiej. Artykuł opiera się na źródłach takich jak Dziennik Urzędowy Ministerstwa byłej Dzielnicy Pruskiej, Tygodnik Urzędowy / Tygodnik Naczelnej Rady Ludowej, aktów prawa państwa pruskiego i niemieckiego oraz materiałach znajdujących się w Wojskowym Biurze Historycznym w Warszawie (dawne Centralne Archiwum Wojskowe w Warszawie) oraz Archiwum Państwowym w Poznaniu.
