The article presents social benefits and costs connected with the realization of public investment while applying negotiating and arbitrary solutions, such as special purpose act. In the first part of the article, the Authors discuss social attitude to realization of the above mentioned investments and their determinants. The second part contains extensive, and based on the results of empirical studies, analysis of benefits and dangers connected with application of special purpose acts, as well as integrative and negotiating solutions. The Authors reach the conclusion that according to effective problem solving methods, negotiating solutions are worth recommending. Taking into account the high socio-economic costs, special purpose act- solutions ought to be used incidentally towards opponents and irrational individuals, who work against the investment, after utilizing all negotiation possibilities.

It is considered that during the last 20 percent of the negotiation process participants make as much as 80 percent of all concessions, whereas during the first 20 percent of the negotiation time they are wasting their time. We conducted analyses of the processes of negotiations of 19 negotiation role-playing games. The analyses were conducted on the basis of the Dynamical Negotiation Network (DNN) model. The results prove that during the early stages of a negotiation important processes take place, which influence the final outcome of the negotiation.
