This article deals with the entry barriers for NFT projects on the market. It discusses issues related to capital intensity, legal regulations, access to knowledge and patents, as well as the diversity of products and suppliers in the NFT market. The aim of the paper is to identify and describe entry barriers that new companies face when entering the market. The authors predict that as consumer interest grows, entrepreneurs will become more interested in launching NFT projects and can use the presented results to streamline their entry process into the NFT market. The first stage of the work introduces the problem tackled, in which the authors explain blockchain technology and present an overview of the situation prevailing in the NFT market, which was the motivation for the creation of this article. In the next part, based on case studies, the authors discuss five entry barriers for NFT projects. The final part presents conclusions, based on which the authors state that entry barriers to the NFT market are small and attractive to entrepreneurs, which, along with the influx of new consumers, may indicate an increase in the number of new projects released on the examined market in the near future.

Niniejsza praca traktuje o barierach wejścia na rynek dla projektów NFT. Porusza zagadnienia związane z kapitałochłonnością, regulacjami prawnymi, dostępem do wiedzy i patentów, a także ze zróżnicowaniem produktów i dostawców na rynku NFT. Celem pracy jest identyfikacja i opis barier wejścia, które napotykają nowe przedsiębiorstwa wchodzące na rynek. Autorzy przewidują, że wraz z rosnącym zainteresowaniem konsumentów wzrośnie zainteresowanie uruchomieniem projektów NFT przez przedsiębiorców, którzy będą mogli wykorzystać przedstawione wyniki, aby usprawnić swój proces wejścia z projektem NFT na rynek. Pierwszym etapem pracy jest wprowadzenie w podjętą problematykę, w którym autorzy wyjaśniają technologię blockchain oraz przedstawiają zarys sytuacji panującej na rynku NFT, która była motywacją do powstania niniejszego artykułu. W kolejnej części, bazując na studiach przypadków, autorzy omawiają pięć barier wejścia na rynek projektów NFT. W końcowej części natomiast przedstawione są wnioski, na podstawie których autorzy stwierdzają, że bariery wejścia na rynek NFT są małe i atrakcyjne dla przedsiębiorców, co wraz z napływem nowych konsumentów może wskazywać na rosnącą w niedalekiej przyszłości liczbę nowych projektów wypuszczanych na badany rynek.

This article has been written to analyze and present the essence of the developing web3 trend and to indicate its economic potential. The first part of the work describes the genesis and key moments in the history of the Internet, divided into three generations. The second part of the thesis was devoted to the analysis of specific areas of activity for the decentralized version of the Internet. The sphere of tokens, decentralized finance and decentralized autonomous organizations is described with an indication of their ecosystems. The last part of the article is devoted to discuss the economic possibilities of the web3 trend. This section shows the growing interest in the topic and refers to specific economic phenomena in the global economy to justify why the web3 trend matters.

Niniejszy artykuł został napisany w celu analizy i prezentacji istoty rozwijającego się trendu web3 oraz wskazania jego potencjału ekonomicznego. W pierwszej części pracy opisano genezę oraz kluczowe momenty w historii internetu wraz z podziałem na trzy generacje. Druga część pracy została poświęcona analizie charakterystycznych obszarów działalności dla zdecentralizowanej wersji internetu. Opisano sferę tokenów, zdecentralizowanych finansów i zdecentralizowanych autonomicznych organizacji wraz ze wskazaniem ich ekosystemów. Ostatnia cześć artykułu przeznaczona została na omówienie ekonomicznych możliwości trendu web3. W tej części ukazano rosnące zainteresowanie tematem oraz powołano się na konkretne zjawiska ekonomiczne zaistniałe w globalnej gospodarce by uzasadnić, dlaczego trend web3 ma znaczenie.

Narodowe Centrum Kultury prowadzi projekt badawczy typu foresight, dotyczący wpływu wschodzących technologii na sztukę. W artykule przedstawiono pierwsze wnioski z analizy możliwości stwarzanych przez rozwój wirtualnych przestrzeni, dostępnych dla artystów i publiczności – mających prowadzić do powstania Metawersum – oraz nowej formy własności, jaką jest NFT. Tekst poświęcony został potencjałowi nowych narzędzi i mediów, a więc pozytywnym aspektom styku najnowszych technologii i sztuki. W artykule można znaleźć definicję Metawersum, NFT oraz sztuki cyfrowej. Te elementy rzeczywistości społecznej (oraz technologicznej) okazują się nie tylko zazębiać, ale i dopełniać. Tekst odpowiada na pytanie, jaki potencjał dla artystów sztuk wizualnych niesie ze sobą kolejna faza transformacji cyfrowej.

The National Centre for Culture is conducting a foresight research project on the impact of emerging technologies on the arts. The article presents the first findings brought by the analysis of opportunities created by the development of virtual spaces accessible to artists and the public – which are expected to create the Metaverse and promote a new form of ownership, NFT. The text is dedicated to the potential of new tools and media – the positive side of the interface between modern technologies and art. The article offers definitions of the Metaverse, NFT and digital art. Apparently, these elements of social (and technological) reality not only overlap, but also complement each other. The text attempts to answer the question of what potential the next phase of digital transformation brings for visual artists.

The article describes the legal regulations related to raising funds for the operation of a non-governmental organization with the use of selected digital solutions. Its purpose is to present the regulatory environment and the main requirements resulting from it, which must be taken into account by non-governmental organizations planning their fundraising activities with the use of new technologies. It examines the subject of distributed ledger technology (DLT) and crypto-assets based on it, including cryptocurrencies and tokens, in particular NFT. In addition, it analyzes issues related to crowdfunding and its various types, as well as the issuance of electronic money.

Artykuł opisuje prawne regulacje związane z pozyskiwaniem środków na działanie organizacji pozarządowych za pomocą wybranych rozwiązań cyfrowych. Celem opracowania jest przedstawienie środowiska regulacyjnego oraz głównych wymagań z niego wypływających, które muszą być brane pod uwagę przez organizacje pozarządowe planujące swoje aktywności w pozyskiwaniu środków przy użyciu nowych technologii. W tekście poruszono tematykę technologii rozproszonego rejestru (DLT) oraz bazujących na niej kryptoaktywów, w tym kryptowalut i tokenów, szczególnie NFT, przeanalizowano również kwestie związane z finansowaniem społecznościowym i jego różnymi odmianami oraz emisją pieniądza elektronicznego.

Tworzenie i sprzedaż NFT jako szansa i wyzwanie dla współczesnych muzeów

NFT zyskały ogromną popularność w 2021 r. i znalazły się w kręgu zainteresowań światowych muzeów, które borykają się z trudnościami finansowymi wywołanymi przez pandemię COVID-19. Tworzenie NFT na podstawie muzealiów i ich sprzedaż na rynku międzynarodowym dla muzeów może być jednym ze sposobów na pozyskanie dodatkowych funduszy na działalność tych instytucji. Celem opracowania jest analiza wyzwań i możliwości dotyczących tworzenia i sprzedaży NFT przez muzea, uwzględniając art. 9 Ustawy z dnia 21 listopada 1996 r. o muzeach. W artykule wskazano na wybrane szanse i wyzwania, takie jak: niestabilność wartości kryptowaluty, zainteresowanie zwiedzających daną tematyką czy relacja prawa własności NFT do prawa własności muzealiów oraz wymogi sprzętowe i kadrowe, z którymi muzeum musi się zmierzyć przed podjęciem ostatecznej decyzji. Przybliżone zostały również opinie na ten temat, pozyskane w ramach badania sondażowego przeprowadzonego we wrześniu 2022 r.

The aim of the article (part 1) is to analyze the metaverse from the perspective of key challenges for regulation. The analysis continues with the issue of opportunities and threats for business. There are different opinions about the potential implications of the metaverse for people and business. Some researchers believe that this is just an incremental development of augmented (mixed) reality, a trend of social networking, gaming and entertainment development, without the features of a disruptive innovation. Others point to qualitative changes in the Internet environment, already affecting the penetration of the metaverse by corporations and new business models. Research methods are – a review of literature, law and jurisprudence, including the economic analysis of law.

Celem artykułu (cz.1) jest analiza metaverse z perspektywy kluczowych wyzwań dla regulacji, jak również kwestie szans i zagrożeń dla biznesu. Istnieją różnice poglądów na temat potencjalnych implikacji metaverse na ludzi i biznes. Część badaczy sądzi, że jest to tylko inkrementalny rozwój rozszerzonej (mieszanej) rzeczywistości, trend rozwoju serwisów społecznościowych, gamingu i rozrywki, bez cech przełomowej innowacji. Inni wskazują na jakościowe zmiany środowiska Internetu, już obecnie wpływające na penetrację metaverse przez korporacje i nowe modele biznesowe. Metody badawcze to przegląd literatury, prawa i orzecznictwa, z uwzględnieniem ekonomicznej analizy prawa.

Celem badań jest wskazanie kierunków rozwoju lub wykładni regulacji prawnych zwłaszcza dla zdecentralizowanych metaverse i ich wpływu na biznes (np. ochronę danych oraz własności intelektualnej i przemysłowej, blockchain i tokenizację NFT, kooperację i konkurencję), a także dla scentralizowanych metaverse (np. ochronę konkurencji i konsumenta). Metody badawcze – to przegląd literatury, prawa i orzecznictwa, z uwzględnieniem ekonomicznej analizy prawa.
