Celem artykułu jest opis i próba wyjaśnienia przebiegu zmian prawnych w zakresie przekształceń ustawy o przeciwdziałaniu narkomanii (UPN) w Polsce w latach 1997-2005 z perspektywy nowej ekonomii instytucjonalnej. Szczególnym obszarem zainteresowania pozostaje jednak karanie za posiadanie narkotyków. Dodatkowym zamierzeniem jest próba odpowiedzi na pytanie, czy zmiany UPN w zakresie karania za posiadanie niewielkich ilości substancji odurzających nie doprowadziły do zakłóceń w obrębie systemu instytucjonalnego, czyli w sieci wzajemnych powiązań między strumieniami działań w gospodarce. W artykule zawarto próbę zidentyfikowania narzędzi pozwalających analizować dynamiczny proces przekształceń instytucjonalnych, do których należą m.in. normatywna i ekonomiczne teorie regulacji oraz ścieżka rozwoju. Ich wykorzystanie uprawdopodabnia właściwą identyfikację przyczyn zmian prawnych dotyczących ustawy o przeciwdziałaniu narkomanii.

The aim of the article is to describe and attempt to explain the course of legal changes in the scope of transformations of the Drugs Prevention Act (UPN) in Poland in 1997-2005 from the perspective of the new institutional economy. However, the punishment for possession of drugs remains a particular area of interest. An additional intention is to attempt to answer the question whether changes to the UPN as regards punishing for possessing small amounts of intoxicants did not lead to disturbances within the institutional system, i.e. a network of interrelations between the streams of activities in the economy. The article presents an attempt to identify the tools that allow to analyze the dynamic process of institutional transformations, which include i.a. normative and economic theories of regulation and development path. Their use makes it possible to correctly identify the causes of legal changes regarding the act on counteracting drug addiction.
