The historical experience of the Nazi era and the former GDR caused that nowadays the public in Germany gives particular attention to the Constitutional State (Rechtstaat). In everyday routine the Constitutional State appears particularly under the slogan of legal protection, judicial control as excercised by independent judiciary, the fair trial, the judicial hearing and the stages of appeal. The author describes the topical problem of the Constitutional State, the tension between the legal certainty and justice, parliament and jurisdiction, and illustrates his discussion with practical examples. Like any other societas constituta et ordinata thus also the Church needs judicial authorities to settle its internal conflicts. The author reports the efforts that are made to reduce the evident deficit in the legal protection (e.g. in the areas of labour law and penal law) mainly on the level of local Church.

The purpose of this article is to present and analyze the foundations and premises of Nazi cultural policy, and the bodies responsible for its implementation, the two most important ones being: National Socialist Society for German Culture and the Ministry of National Enlightenment and Propaganda of the Reich. Policy in this case is interpreted as intentional activity of the authorities in the field of culture, aimed at influencing the attitudes and identity of the population of the Third Reich. The analysis covers the most important documents, statements and declarations of politicians and their actual activity in this domain. Adopting such a broad perspective allowed to comprehensively show both the language and the specific features of the messages communicated by the Nazi authorities, and its impact on cultural practices.

The study deals with the Aryanization of Jewish property in the area of Vsetín within the broader context of events taking place in Central Europe. Aryanization started in Germany in the years 1933-1938. After the Munich Agreement, the process continued in the former Czechoslovak regions with German population known as Sudetenland that had been attached to Germany. With the establishment of the Protectorate of Bohemia and Moravia the Aryanization concept was officially introduced in the Bohemian Lands, although some claims concerning the Jewish property had already been raised during the Second Republic (1938–1939). After a general outline of previous research into this topic the main legislative and institutional aspects of the process from 1933 to 1942 are described. The core of the study consists in an analysis of particular cases of Aryanization in the region under consideration between 1939 and 1945. Special attention is paid in the paper to the expropriation of Jewish trades, businesses, and real property. Inseparable parts of the process are also some accompanying measures, such as exclusion of the Jewish community from the participation in local self-government and from local economic corporations.
