Celem artykułu jest zwrócenie uwagi na funkcjonowanie konstytucyjnych gwarancji wolności i praw człowieka zawartych w treści konstytucji Boliwariańskiej Republiki Wenezueli. Autor odnosi się do problematyki stanu ochrony praw człowieka, w tym rozwoju instytucji gwarantujących ich ochronę w kontekście autorytarnego modelu sprawowania władzy w tym państwie. Praca stanowić ma teoretyczną próbę ujęcia problemu funkcjonowania instytucji ochrony praw człowieka w Wenezueli na szczeblu konstytucyjnym, w okresie następującym po zdobyciu władzy przez prezydenta Nicolasa Maduro. Artykuł ma umożliwić odpowiedź na pytanie, w jakim stopniu w Wenezueli nastąpiła erozja konstytucyjnych gwarancji ochrony wolności i praw człowieka w kontekście sprawowania władzy przez obóz chawistów. Wskazuje jednocześnie, jak petryfikacja systemu władzy przez Nicolasa Maduro oddziałuje na stan ochrony praw człowieka w tym państwie.

The purpose of the article is to draw attention to the functioning of constitutional guarantees of human rights and freedoms contained in the Constitution of the Bolivarian Republic of Venezuela. The author addresses the issue of human rights protection, including the development of institutions guaranteeing their protection in the context of the authoritarian model of governance in Venezuela. The paper is a theoretical attempt to present the problem of the functioning of human rights institutions in Venezuela at the constitutional level after the seizure of power by President Nicolas Maduro. It also attempts to determine to what extent the Chavista camp suspended constitutional guarantees of protection of human rights and freedoms in Venezuela. At the same time, the article describes how the petrification of the system of power by Nicolas Maduro affects the state of human rights protection in the country.

Celem artykułu jest określenie roli odgrywanej przez Najwyższy Trybunał Sprawiedliwości w systemie politycznym współczesnej Wenezueli oraz zakresu rzeczywistego wpływu władzy wykonawczej na sądownictwo. Sformułowany problem badawczy dotyczy ustalenia faktycznego znaczenia Trybunału w utrzymaniu chavistów u władzy. Artykuł porównuje kompetencje materialnoprawne Najwyższego Trybunału Sprawiedliwości z realiami politycznymi ostatnich lat oraz wskazuje główne powody, dla których działania Trybunału podejmowane w ostatnich latach budzą tak wiele kontrowersji. Wskazano, że kontrola chavistów nad Najwyższym Trybunałem Sprawiedliwości jest istotnym czynnikiem umożliwiającym zwolennikom Nicolasa Maduro sprawowanie sądowej i pozasądowej kontroli nad instytucjami sądownictwa oraz wpływanie na władzę ustawodawczą.

The aim of this article is to define the role played by the Supreme Tribunal of Justice in the political system of contemporary Venezuela and determine the extent of the executive branch’s actual influence on the judiciary. The research problem formulated by the author concerns the determination of the actual importance of the Tribunal in keeping the Chavistas in power. The paper compares the substantive legal competences of the Supreme Tribunal of Justice with the political realities of the recent years and shows the main reasons why the Tribunal’s activities undertaken in recent years have raised so much controversy. It has been pointed out that the Chavistas’ control of the Supreme Tribunal of Justice is a meaningful factor enabling the supporters of Nicolas Maduro to exercise judicial and extrajudicial control over the institutions of the judiciary and influence the legislature

Celem niniejszego artykułu jest analiza kryzysu humanitarnego Wenezueli ze szczególnym uwzględnieniem znaczenia problemów migracji regionalnej i zaangażowania społeczności międzynarodowej. Wstęp do rozważań koncentruje się na preludium obecnego kryzysu uchodźczego oraz na głównych założeniach merytoryczno-metodologicznych. Następnie skupiono się na dwóch głównych obszarach badawczych: a) najważniejszych społecznych, gospodarczych oraz politycznych przyczynach kryzysu migracyjnego Wenezueli, b) zaangażowaniu społeczności międzynarodowej w problemy migracyjne Wenezueli ze szczególnym uwzględnieniem działań Unii Europejskiej, Organizacji Narodów Zjednoczonych, Organizacji Państw Amerykańskich, rządów państw Ameryki Łacińskiej oraz Stanów Zjednoczonych. Biorąc pod uwagę wskazane założenia, hipoteza artykułu wskazuje, że kryzys migracyjny Wenezueli zarówno jest spowodowany kryzysem humanitarnym państwa, jak i pogłębia go, wywołując efekt sprzężenia zwrotnego. W artykule zastosowano metody: instytucjonalno-prawną, systemową, analizę treści oraz metodę statystyki opisowej.

The aim of this paper is to analyze the dimension of the humanitarian crisis of Venezuela, with a particular emphasis on the importance of regional migration problems and the involvement of the international community. The article consists of an introduction that focuses on the background of the current migration crisis, especially in terms of substantive and methodological assumptions and the theoretical perspective. Then, the article focuses on analyzing two major research areas: a) the main social, economic, and political causes of the Venezuelan migration crisis; the effects and causes of the crisis for both the Venezuelan economy and the security of the Latin American region; and b) the involvement of the international community, with a particular emphasis on the activities of the European Union, the United Nations, Latin American governments and the United States. Hence, the hypothesis indicates that the problem concerning the migration crisis of Venezuela is both caused by and deepens further socio-economic problems of the country, causing a feedback effect. The article is prepared based on an institutional and legal method (analysis of selected initiatives and the shape of public policies supporting the problem of the refugee crisis of Venezuela); systemic (analysis of the impact of the migration crisis on regional security in Latin America); content analysis (in particular documents and statutes of international organizations and governments); descriptive statistics method (analysis of statistical data related to the scale of the economic crisis of Venezuela and the population affected by the refugee problem). The results of the article indicate that the possibilities of handling the migration crisis are still limited due to the lack of coordination of the actions of the Venezuelan government and international organizations.
