The article presents data of the Blue Cards from the Warsaw VI District Police Headquarters from 2015 (VII-XII) -2018 (I-III). Special attention was paid to such issues as: the profiles of the perpetrator and victim of domestic violence, types of violence and its frequency, committing acts of violence under the influence of alcohol and the effects of such acts, as well as elements of the amendment of Article 207 of the Criminal Code. Particular issues from the empirical part were compared with previous studies carried out by the author in the subject of the study.

Artykuł przedstawia dane Niebieskich Kart z Komendy Rejonowej Policji Warszawa VI z lat 2015 (VII-XII) – 2018 (I-III). Zwrócono szczególną uwagę na takie zagadnienia jak: profil sprawcy i ofiary przemocy w rodzinie, rodzaje przemocy i jej częstotliwość, popełnianie aktów przemocy pod wpływem alkoholu i skutki takich czynów, a także elementy nowelizacji art. 207 k.k. Poszczególne zagadnienia z części empirycznej zostały porównane z wcześniejszymi badaniami przeprowadzony­mi przez Autorkę w ukazanym przedmiocie badań.

Artykuł prezentuje dane Niebieskich Kart z Komendy Powiatowej Policji w Żyrardowie pochodzące z lat 2012-2015. Zwrócono uwagę na takie zagadnienia, jak: liczba wypełnionych formularzy Niebieskich Kart na przestrzeni wskazanych lat, miejsce zamieszkania osób je wypełniających, charakterystykę ofiar i sprawców przemocy w rodzinie, liczbę osób zatrzymanych stosujących przemoc w rodzinie, sprawców przemocy domowej pod wpływem alkoholu oraz rodzaje przemocy i pomoc udzieloną jej ofiarom. Wybrane zagadnienia z części empirycznej zostały porównane z wcześniejszymi badaniami przeprowadzonymi przez Autorkę w omawianym przedmiocie badań.

The article introduces the Blue Cards data of the District Police Headquarters in Żyrardów from the period of 2012-2015. It concentrates on such issues as: the number of completed forms of Blue Cards over the mentioned period of time, the domicile of persons filling them up, the profile of victims and perpetrators of domestic violence, the number of domestic violence perpetrators detained by the police, perpetrators under the influence of alcohol and types of violence and the help offered to victims. Selected issues from the empirical part were compared with the earlier research conducted by the Author in the discussed subject area.

Ensuring inviolabilities of territory and the safety inhabiting them is one of inalienable tasks of you and his structures of citizens. In the environment surrounding us, on the different standards of living, we are encountering threats which they are trying out as well as are disrupting our guaranteed right to the calm life. Undoubtedly a home violence which for many years in Poland was called the „home row” according to custom is one of threats of current world or with „quarrel”. In the scope, mode and under the terms of separate laws and regulations are performing predicted tasks for Police in military forces of the Republic of Poland and towards soldiers the Military Police and military ordinal organs. The Military Police is participating in preventive programs, carrying preventive activities out in military forces the Republic of Poland, from the scope of the counteraction among others: for alcoholism, drug addicts and psychedelic centers, violence in the workplace, of the network security and the corruption. After nearly 6 years, on the day of 01 July 2015 procedural entitlements of the Military Police, and hence offences committed also outside premises of the unit will increase (disconnected with the service) will be subject to a Military Police. Police cannot be an only institution, on which bars a weight of the counteraction of the violence is sitting down in the family, and the phenomenon of recognizing and counteractions of these pathological changes in the environment of the army – including the procedure of the „Blue Card” – must be located in a territory of jurisdiction of the Military Police. With one of basic means of adapting the potential of the military police to planned changes of the procedural property designing statutory processes should constitute Military Police so that she is effective, must have full fan of tools for the detection and preventing of all signs the corruption of living in the family. In the presented article were directed attention to the need to adapt statutory documents to action predicted for the military police for the prevention of violence in the family.

Jednym z niezbywalnych zadań państwa i jego struktur jest zapewnienie nienaruszalności terytorium oraz bezpieczeństwa zamieszkujących je obywateli. W otaczającym nas środowisku, na różnych poziomach życia, spotykamy się z zagrożeniami, które próbują zakłócić oraz zakłócają nasze gwarantowane prawo do spokojnego życia. Jednym z zagrożeń obecnego świata jest niewątpliwie przemoc domowa, która przez wiele lat w Polsce nazywana była zwyczajowo „awanturą domową” lub „kłótnią”. O zjawisku tym mówi się nieczęsto, a dowiadujemy się onim głównie wtedy, gdy dochodzi do tragedii. W zakresie, trybie i na zasadach określonych w przepisach zadania przewidziane dla Policji wykonują w Siłach Zbrojnych Rzeczypospolitej Polskiej oraz w stosunku do żołnierzy Żandarmeria Wojskowa i wojskowe organy porządkowe. Żandarmeria Wojskowa uczestniczy w programach prewencyjnych, realizując czynności profilaktyczne w Siłach Zbrojnych RP, z zakresu przeciwdziałania m.in.: alkoholizmowi, narkomanii oraz środków psychoaktywnych, przemocy w środowisku pracy, bezpieczeństwa w sieci oraz korupcji. Po blisko sześciu latach, z dniem 1 lipca 2015 r., zwiększają się uprawnienia procesowe Żandarmerii Wojskowej, a tym samym przestępstwa popełnione również poza terenem jednostki (bez związku ze służbą) podlegać będą ŻW. Policja nie może być jedyną instytucją, na której barkach spoczywa ciężar przeciwdziałania przemocy w rodzinie, a zjawisko rozpoznawania i przeciwdziałania tej patologii w środowisku wojska – w tym procedura Niebieskiej Karty – musi znajdować się w jurysdykcji Żandarmerii Wojskowej.

The domestic violence called the family violence is any kind of the deliberate behaviour connected with the taking advantage from the force predomination directed against the family member which violates the family member's rights and results in physical and psychical suffering. The violence is a kind of pathology. Simultaneously, the domestic violence is a crime, but most of its victims are not aware of the fact that this behavior pattern is rooted in their families. They allowed to be abused as well as they permit the child abuse and treat it as normal. The examinations conducted amongst the domestic violence victims show that the victims act unconsciously according to the stereotypes and thought schemes repeated from generation to generation. There are many forms and methods of the violence victims’ assistance, but the efficiency most of all depends on the reaction time of the adequate services and their assistance. Therefore, the construction of the assistance net for the domestic violence victims is so crucial. The net should react in the adequate way as soon as it is possible. There must be the change in the society attitude towards the specialists helping the domestic violence victims as well as the change in the victims attitude. Only then the full success in carrying help to the domestic violence victims will be possible.

The aim of this paper is to analyse and evaluate the system of protection and prevention of family violence, as well as to compare the legal assumptions with the practice of their application. The paper points out various possibilities of preventing violence, both direct and indirect, as well as the difficulties of taking actions, which are caused by the complexity of the phenomenon of family violence. The review of police statistics shows how the scale of this phenomenon is changing against the background of the changing system.

Celem pracy jest analiza i ocena systemu służącego ochronie praw ofiar przemocy w rodzinie oraz przeciwdziałaniu przemocy, a także skonfrontowanie założeń prawnych z praktyką ich stosowania. Wskazane zostały różne możliwości, jakie są wykorzystywane w celu przeciwdziałania przemocy, zarówno bezpośrednie, jak i pośrednie. A także trudności, jakie widoczne są w podjętych działaniach, które źródło swe mają w złożoności zjawiska, jakim jest przemoc w rodzinie. Przegląd statystyk policyjnych ukazuje, jak zmienia się skala tego zjawiska na tle zmieniającego się systemu.
