Zmiany w systemie ochrony informacji niejawnych

Uchwalona 5 sierpnia 2010 r. Ustawa o ochronie informacji niejawnych zastąpiła obowiązującą od ponad 11 lat Ustawę z dnia 22 stycznia 1999 r. o ochronie informacji niejawnych . Podstawową przesłanką przemawiającą za dokonaniem zmian w systemie bezpieczeństwa tego rodzaju informacji była konieczność dostosowania istniejących już rozwiązań do współczesnych realiów, a zwłaszcza nowych wyzwań i zagrożeń. Ponadto niewątpliwy wpływ na uchwalenie nowego aktu prawnego miały liczne głosy krytyki w stosunku do dotychczas funkcjonującego systemu, gdzie wskazywano chociażby na jego anachroniczność, niefunkcjonalność, brak elastycznych rozwiązań oraz różnorodność interpretacyjną wielu pojęć i kwestii.

The Act on the Protection of Non-Public Information, adopted on 5 August 2010, is aimed at eliminating existing errors and ambiguities, thus making the system of the state’s information security more transparent and effective. This is to be achieved by a broad spectrum of new legal structures from conceptual solutions (notional and procedural ones) to those of structural or, as one might put it, systemic nature. First of all, the competences were assigned to the Internal Security Agency (Agencja Bezpieczeństwa Wewnętrznego – ABW) and the Military Counterintelligence Service (Służba Kontrwywiadu Wojskowego – SKW). The scope of the act was extended to include the notion of non-public information. Moreover, the possibility of instigating appeal proceedings (ABW or SKW) challenging the assigned confidentiality clause was provided for. In accordance with the new provisions, the head of an organizational units determines the degree of risk and is responsible for the adequacy of the protections used. Other significant changes in the area of citizens' rights and responsibilities concern both the simplification of verification proceedings in the process of application for access to information marked with the RESERVED clause and increasing the requirements in particular in the area of industrial security, which comes down to the obligation to hold a relevant security certificate, starting from the CONFIDENTIAL clause. Entrepreneurs conducting business activity based on sole proprietorship and in person are an exception, as they are only required to confirm their personal security. The examples mentioned above are aimed at presenting the most important changes introduce in the area of the protection of non-public information. Hopefully, they will contribute to making the existing system more efficient optimizing the security of our country and citizens.
