In cases specified in Article 206 par. 2 of the Act on the Telecommunications Law, telecom- munications entrepreneurs have the right to appeal to the Court of Competition and Con- sumer Protection in Warszawa. All provisions of the Code of Civil Procedure, including Ar¬ticle 316 of the CCP, apply to the CCCP procedure. Article 316 of the CCP concerns one of the basic issues of civil procedure, i.e. basis for judgement. However, the application thereof in telecommunications cases provokes certain reflections which lead to the conclusion in compliance with which Article 316 of the CCP is applicable in telecommunications cases when the specificity of these cases is taken into account, especially the fact that the CCCP procedure is supervisory in nature and checks the regulatory activities of the President of the Office of Electronic Communications. The paper analyses judicial decisions of ordinary courts and the Supreme Court in telecommunications cases, as well as social security and energy regulation cases, which due to the major similarities of appeals against decisions is- sued by ZUS and the President of ERO, and appeals against decisions issued by the President of the OEC, may be per analogiam applied to telecommunication cases.

The purpose of this article is to analyze the progress in the telecommunications policy in Poland narrowed down to the objectives enunciated in the Regulatory Strategy until 2015.In the article the thesis that the current progress in the regulatory strategy is gratifying was confirmed. In the theoretical part the telecommunications policy and its role in the economic development are defined as well as the location of the policy in the classification of public policy is indicated. Furthermore, telecommunications market authorities, which are responsible for creating and conducting the policy in the telecommunication sector, are characterised. In the empirical part, which is based on the quantitative data, the foregoing values of indicators showing the progress in meeting the strategy objectives are presented. The conducted quantitative analysis is extended to the actions taken by the Office of Electronic Communications in order to implement the strategy.

Celem artykułu jest analiza stopnia realizacji polityki telekomunikacyjnej w Polsce w zawężeniu do celów sformułowanych w Strategii regulacyjnej do roku 2015. W artykule pozytywnie zweryfikowano tezę, że poziom dotychczasowego wykonania obecnej strategii regulacyjnej jest zadowalający. W części teoretycznej zdefiniowano politykę telekomunikacyjną, dokonano analizy znaczenia tej polityki w rozwoju gospodarczym, a także określono jej lokalizację w klasyfikacji polityki publicznej. Ponadto, scharakteryzowano podstawowe instytucje władcze rynku telekomunikacyjnego, które są odpowiedzialne za kreowanie i realizację polityki prowadzonej w sektorze telekomunikacyjnym. W części empirycznej, opartej na danych ilościowych, zaprezentowano wartości mierników stopnia realizacji celów badanej strategii regulacyjnej. Przeprowadzoną analizę ilościową poszerzono o podejmowane przez Urząd Komunikacji Elektronicznej działania na rzecz realizacji strategii.

In this article was presented the essence of telecom market and its regulation. There was presented legislative history relating to establishment and competence evolution of the regulator of the polish telecom market. There was confirmed the thesis that the regulator activity had an influence on increase of the competition level in individual telecom market segments (fixed network telephony market, mobile telephony market, Internet access). This thesis confirmation as based on described cases of the Office of Electronic Communications activity and analyses of the market concentration indicators, which include Herfindahl-Hirschman's indicator.

Artykuł poświęcony jest modelowi kontroli sądowej decyzji wydawanych przez Prezesa UKE. Model ten jest określony w ustawie z dnia 16.07.2004 r. Prawo Telekomunikacyjne i przewiduje, że kontrolę sądową decyzji wydanych przez Prezesa UKE sprawują sądy administracyjne. Jednakże od niektórych decyzji tego organu przysługuje odwołanie do sądu powszechnego (Sądu Okręgowego w Warszawie – Sądu Ochrony Konkurencji i Konsumentów). Oba rodzaje kontroli sądowej decyzji wydawanych przez Prezesa UKE różnią się od siebie zasadniczo. W związku z tym, głównym celem artykułu jest przedstawienie charakteru prawnego modelu kontroli sądowej decyzji wydawanych przez Prezesa UKE oraz przedstawienie istotnych różnic w sposobach kontroli sądowej sprawowanej przez oba rodzaje sądów, tj. sądy administracyjne oraz sądy powszechne (SOKiK).

The model of judicial control of the decisions of the President of the Offi ce of Electronic Communications (hereinafter the UKE President) is subject of this paper. This model is defined in the Telecommunications Law Act (hereinafter the TL) and provides two different judicial procedures against decisions of the UKE President. It is a general principle that the UKE President decisions are subject to judicial control exercised by administrative courts. However, some decisions enumerated in the TL are subject of judicial review exercised by common courts [the Regional Court in Warsaw – the Court of Competition and Consumer Protection (hereinafter the SOKiK)]. Both types of judicial control differ from each other substantially. Therefore, the main goal of the article was to present a model of judicial control of the decisions made by the UKE President together with an indication of the legal basis of this model. In addition, signifi cant differences were determined in the way of judicial control by both types of courts, i.e. the administrative courts and common courts (SOKiK).
