The article is an attempt to show the form of entering into a mixed marriage in the context of changes in canonical marriage law and the possibility of dispensation from form. The new §3 can. 1108 of KPK in communication with can.1127 and justifies why only a priest can assist and bless marriage when one party belongs to the Eastern Community, excluding a deacon and a lay person, and an attention is paid to entities that can grant a dispensation. The meaning of the new §3 can. 1116 is also explained in the form of an extraordinary marriage with the extended rights of the Catholic ordinary of the place. In the final part, the issue of legal value and the function of the form of marriage in the context of the formal act of leaving the Church are being addressed.

Artykuł jest próbą pokazania formy zawarcia małżeństwa mieszanego w kontekście zmian w kanonicznym prawie małżeńskim i możliwości dyspensowania od formy. Przybliża się też nowy §3 kan. 1108 KPK w łączności z kan.1127 i uzasadnia, dlaczego tylko kapłan może asystować i błogosławić związek małżeński, gdy jedna strona przynależy do Wspólnoty wschodniej, wykluczając diakona i osobę świecką oraz zwraca się uwagę na podmioty mogące udzielić dyspensy. Wyjaśnia się również znaczenie nowego §3 kan. 1116 w formie nadzwyczajnej zawierania małżeństwa przy poszerzonych uprawnieniach katolickiego ordynariusza miejsca. W końcowej części podejmuje się kwestie waloru prawnego i funkcji formy zawarcia małżeństwa w kontekście aktu formalnego wystąpienia z Kościoła.

Issues concerning leaving the Catholic Church are still very much current at this time, especially in European states with an instituted Church tax. Assuming the characters of the formal act of defection from the Catholic Church are met, individual legal effects connected with such acts are also in the area of marriage law, which represented the exception from the established principle of "once a Catholic, always a Catholic". These questions also, due to the vagueness of the legal definition of this institution, infringed on the principle of legal certainty in a number of aspects. The universal lawgiver proceeded on this account to its specification in 2006, with this also being reflected by the rules of particular canon law, and in 2010 to its abrogation. When considering leaving the Catholic Church, the numbers did not decrease drastically in the majority of countries. Regardless of the name of the given institution, a Catholic does not stop being a member of the Church and is henceforth bound by its rules, according to the theological and doctrinal conclusions, as well as the valid canon-law regulations. The main goal of this article is to define the basic concepts, point out the various controversies connected with the application of the institution of the formal act of defection and the coherent legislative changes, including their impact on particular Church practice.
