In accordance with the principle of the functional connection of the administrative judiciary and the non-criminal supervision of the prosecutor‘s office, the Code of the administrative court procedure granted the prosecutor a new powers within the framework of administrative court proceedings, the main purpose of which is to protect legality. In addition to the right to file a lawsuit in a whole range of administrative court proceedings after fulfilling the conditions established by law, the prosecutor is entitled to enter any proceedings before the administrative court. The Code of the administrative court procedure modified the prosecutor‘s authority to enter proceedings before the administrative court absolutely. The aim of this paper is to focus on this authorization and, even with the use of a historical probe, to think about whether such an authorization of the prosecutor in administrative court proceedings is justified. Doesn‘t such scope of the prosecutor‘s entry authority in the administrative judiciary exceed the very purpose of the administrative judiciary?
