Uznanie za zmarłego wywołuje skutki cywilnoprawne tożsame ze skutkami wywołanymi śmiercią. W artykule, w oparciu o regulację kodeksową, poglądy doktryny oraz orzecznictwo Sądu Najwyższego scharakteryzowano istotę tej instytucji. Dokonano analizy przesłanek oraz skutków prawnych uznania za zmarłego. Omawianą problematykę uzupełniono także o wybrane zagadnienia procesowe dotyczące sądowego postępowania o uznanie za zmarłego.

Declaring a person dead causes civil and legal consequences identical to the effects caused by natural death. The issue of this institution has been described in the article based on code regulations, doctrinal views and the Supreme Court's jurisdiction. The analysis of necessary conditions and legal consequences of declaring the person dead have also been discussed in the article. Some issues connected with judicial proceedings to declare a person dead has been added here, as well.
