Despite the fact that almost 20 years have lapsed from the moment Poland adhered the Protocol No. 1 to the European Convention on Human Rights, there are still cases pending before the ECHR that concern legal situations created before the date of ratification of the Protocol on 10 October 1994. The uncertainty concerning the Court’s ruling affects not only the potential applicants, but also the Government, which can not be sure about the scope of international obligations imposed on it. The article focuses on identifying two situations in which the potential applicants, whose property rights were object of the State’s interference before the entry into force of Protocol No. 1 for Poland, can successfully submit their claims to the Court. The first one being the case of a continuing situation when the applicant can claim being before and after 1994 in the possession of a proprietary interest falling within the ambit of Protocol No. 1. The second one occurs when the applicant that was deprived of their property before the ratification receives after it from the competent authorities a decision declaring that the ownership should not have been subject to expropriation being tantamount to conferring on the applicant a new proprietary interest.

Własność i prawa własności kształtują się pod wpływem szeroko rozumianych czynników historycznych. Wpływają one zarówno na sam proces kształtowania pojęcia oraz instytucji własności, jak i na jego finalny rezultat. Uwarunkowania polityczne, religijne i społeczne przesądziły o istotnej różnicy między Ameryką a Rosją. W pierwszym przypadku mamy do czynienia z silną obecnością idei wolności i podmiotowości obywatela; w drugim zaś z obecną przez wiele stuleci ideą nadrzędnej roli państwa i braku znaczenia jednostki. Wykorzystanie relacji i źródeł historycznych pozwala na identyfikację głównych czynników, które prowadziły do ukształtowania systemu republikańskiego oraz systemu despotycznego. Wyjaśnia to przyczyny silnego rozwoju praw własności w Ameryce oraz ich ułomności i ograniczoności w Rosji.

Property and property rights are formed under the influence of broadly understood historical factors. These factors affect both the formation process of the concept and institution of property as well as its final outcome. Political, religious and social conditions determined the profound difference between America and Russia. In case of the former, the key concepts have always been freedom and civil rights, whereas in case of the latter, the superiority of the state and insignificance of a single individual. The use of historical reports and sources enables us to identify the main factors which lead to the establishment of both the republican and despotic systems. It also explains the reasons for such a strong development of property rights in America and their defectiveness and limitation in Russia.

W artykule rozważono wkład twierdzenia Coase’a w narodziny ruchu nowej ekonomicznej analizy prawa. Coase podjął się pierwszej próby zastosowania ekonomicznej analizy do tych obszarów prawa, które w sposób bezpośredni nie dotykały kwestii ekonomicznych. Traktował regulacje prawne jako czynnik, który przy dodatnich kosztach transakcyjnych, ma zdolność do wywierania wpływu na rozwój całej gospodarki. Wskazał, że stosowanie narzędzi ekonomii może poprawić efektywność funkcjonowania prawnych instytucji i nadać ich właściwy kształt.

The article examines the contribution of the Coase theorem in motion the birth of a new economic analysis of law. Coase undertook the first attempts to applyeconomic analysis to those areas of law that did not directly touch the economic issues. He treated the regulation as a factor that with positive transaction costs, has the ability to influence the development of the whole economy. He pointed out that the use of economic tools can improve the efficiency of the functioning of the institutions and give them proper shape.

Brak dobrze zdefiniowanych praw własności hamuje rozwój cywilizacyjny.

The property belongs to the man. It brings forth in connection with taking conscious decision. The property becomes a part of the collective memory and cultural heritage of the nation. The property combines not only with possession but also with authorization. The tendency to accumulating depends on authorization and the structure of property rights. Human development is suppressed by the lack of well-defined property rights.

Artykuł zawiera krytykę materialistycznej koncepcji kapitału. Uzasadniono w nim tezę, że kapitał jest procesem, a nie zasobem dóbr potencjalnie wymiennych. Proces ten jest niesamoistny, ponieważ jego fundamentem bytowym są działania podporządkowane realizacji zysku. Jest bytowo niesamodzielny, gdyż występuje tylko w gospodarce towarowo-pieniężnej. Finansyzacja zmniejsza kapitał pieniężny.

This article contains criticism of the materialist conception of capital. It substantiates thesis that capital is a process, not a resource of potentially exchangeable goods. This process is not inherent because its fundament of being is based on operations subordinated to profit-taking. It is also ontically dependent because the process happens only in Money-Goods Economy. Financialization reduces money capital.
