Whistleblowing w środowisku akademickim – uwagi de lege lata i de lege ferenda

The purpose of this article is to provide external and internal legal protection against adverse employment-related activities available to employees of higher education institutions in Poland, who disclose information of public significance to which they have access, risking this disciplinary and professional liability. The article focuses on the consequences of a particular type of behavior, which is commonly referred to as „reporting irregularities“ or „whistleblowing.“ Since an academic teacher‘s employment relationship in Poland is such that the employer, when terminating the employment relationship, must state the reason for such a decision. Although academic teachers are required to comply with the Act on Higher Education and Science of 2018 and the Labor Code in the unregulated area, it should not be forgotten that there are additional legal requirements specific to their status.

Celem niniejszego artykułu jest przedstawienie zewnętrznej i wewnętrznej ochrony prawnej przed niekorzystnymi działaniami związanymi z zatrudnieniem, dostępnej dla pracowników instytucji szkolnictwa wyższego w Polsce, którzy ujawniają informacje o znaczeniu publicznym, do których mają dostęp, ryzykując poniesieniem odpowiedzialności dyscyplinarnej i zawodowej. Artykuł koncentruje się na konsekwencjach określonego rodzaju zachowania, które jest powszechnie określane jako „informowanie o nieprawidłowościach” czy „whistleblowing”. Ponieważ stosunek pracy nauczyciela akademickiego w Polsce jest taki, że pracodawca, rozwiązując stosunek pracy, musi podać przyczynę takiej decyzji, przegląd środków ochrony dostępnych dla nauczycieli akademickich jest studium wyjątków. Chociaż nauczyciele akademiccy są zobowiązani do przestrzegania nie tylko ustawy o szkolnictwie wyższym i nauce z 2018 roku, ale także kodeksu pracy w zakresie nieuregulowanym, to nie można zapomnieć, że istnieją dodatkowe wymogi prawne charakterystyczne dla ich statusu.
