The aim of this legal opinion is to answer the question of whether a Sejm Deputy (i.e. an MP) who has formally supported a preliminary motion for holding a public official accountable before the Tribunal of State may be a member of the Constitutional Accountability Committee, which is to consider the said motion. An analysis of relevant constitutional-law provisions and literature presented in this opinion leads to the conclusion that there is currently no such prohibition.

The aim of this legal opinion is to answer the question whether the Chairperson of the Sejm’s Constitutional Accountability Committee has the power to decide to prohibit a member of the said Committee from accessing documents from the Committee’s meetings. An analysis of the provisions of the Sejm’s Standing Orders and of the Act on the Exercise of Mandates by Sejm Deputies and Senators leads to the conclusion that the Chairperson of the Sejm’s Constitutional Accountability Committee does not have such powers.
