Since the beginning of 1999 a fundamental reorganization of the social security system was introduced, which has substantially changed the existing mechanisms of its functioning. Within this reform a situation of the main social security performer, The Social Security Institution, had undergone a great changement in executive as well as organizational and legal form. As a consequence of the above mentioned rarely commented on and considered outcomes have appeared and determined further functioning of the Institution. Filling this gap, hereby the author takes upon a subject of the transformation of The Social Security Institution into the state administration body, equipped with legal personality, as well as issues related to the “transfer” of the employees of the state administration into the new unit, and endowment of the newly formed entity with possessions. He also does not leave unmentioned the subject of the liability and legal responsibility for the predecessor. The situation of the Institution as a legal successor of social insurance institutions, operating sine 1950, and as a successor of the further organizational units competent in the matters of pensions and annuities was also discussed. The author analyzes the organizationally and legally transformed institution, and puts a big emphasis on its legal status as a legal personality, introducing a conclusion by mentioning that the Social Security Institution is primarily a state organization unit and only then a legal personality and that its dualistic character can favourably affect the fulfillment of its statutory assigned tasks.

Jednym z elementów polityki społecznej państwa jest funkcjonowanie Zakładu Ubezpieczeń Społecznych. Ma on na celu zabezpieczenie bytu oraz podstawowych potrzeb materialnych świadczeniobiorców. Zakład jest instytucją, która obsługuje system ubezpieczeń społecznych. Zapewnia on bezpieczeństwo socjalne na wypadek choroby, inwalidztwa, starości oraz śmierci. ZUS jest połączeniem instytucji finansowej (pobór składek, wypłata świadczeń, pobór podatków od emerytur i rencistów) z instytucją społeczną. Do ZUS-u każdego miesiąca wpłacane są składki na ubezpieczenia społeczne za 14,5 mln osób, które wpłaca ponad 2 mln płatników. Z ZUS-u wypłacane jest co miesiąc 7,3 mln emerytur i rent oraz 400 tys. zasiłków i innych świadczeń krótkoterminowych wynoszących łącznie około 14 mln zł. Funkcjonowanie Zakładu kosztuje niewiele ponad 2% obsługiwanych pieniędzy. W stosunku do skali realizowanych zadań jest to kwota niska. Kwota ta praktycznie nie zmieniała się od lat ze względu na zamrożenie płac budżetówki.

The functioning of the Social Security Institution (ZUS) is one of the elements of social policy of the State It aims at securing existence and fundamental needs of benefit recipients. The Institution is an entity which handles the social security system. It ensures social security in case of sickness, disability, old age or death. The Social Security Institution is a combination of a financial institution (contribution collection, payment of benefits, tax collection from old-age pensioners and recipients of sickness allowances) with a social institution. Every month social security contributions are paid to ZUS for 14,5 million persons; they are contributed by over 2 million taxpayers. Every month 7,3 million pensions and sickness allowances are paid from ZUS as well as 400 thousand securities and short-term benefits which total around PLN 14 million. The functioning of the Institution cost little, i.e. over 2 % of money in its operations. In relation to the scale of tasks performed, this amount is low. It has stood practically at the same level for years due to a public sector pay freeze.
