L’istituto della vincolatività del precedente tra prevedibilità delle scelte giurisdizionali e libertà di stabilimento

The article deals with the new binding role of rulings in Italian law system, in particular concerning the administrative appeal trials. It first summarizes the statutes, which have altered the previous conformation of judiciary system, and the evolution of the relationship between law and judges. It then analyzes the rulings concerning security costs and tries to evaluate how the binding ruling (stare decisis) has affected Italian public tender market.

L’articolo affronta il nuovo ruolo della vincolatività dei precedenti nell’ordinamento italiano con speciale riferimento ai giudizi amministrativi d’appello. Riassume dapprima le disposizioni che hanno modificato l’assetto del sistema giudiziario e l’evoluzione del rapporto tra la legge ed i giudici. Infine, analizza le decisioni riguardanti i costi della sicurezza interna e prova a valutare l’impatto sul mercato degli appalti pubblici della vincolatività dei precedenti (stare decisis).

W trakcie kwerend w 2018 r. w Archiwum Państwowym w Wiedniu autor przeprowadził m.in. rejestrację poloników w Archiwum Wojny (Kriegsarchiv), w zespole Naczelnej Komendy Armii (Armeeoberkommando - AOK), w podzespole Oddział Kwatermistrzowski (Quartiermeisterabteilung - Qu.Abt.). W przebadanych 8 kartonach (nr 2514–2521), zawierających dokumenty z 1918 r., zarejestrowano liczne polonika. Zarejestrowane materiały dotyczą spraw wojskowości i państwowości polskiej, c. i k. administracji wojskowej na ziemiach polskich, powstającej państwowości ukraińskiej. W dokumentach pojawiają się nazwiska znanych osobistości: regenci Aleksander Kakowski, Zdzisław Lubomirski i Józef Ostrowski, biskup Ignacy Dubowski, minister spraw zagranicznych Austro-Węgier Ottokar Czernin, gen. Jan Dowbor-Muśnicki, gen. Franciszek Kleeberg, Stanisław Kot, Jan Konopka, premier Jędrzej Moraczewski, Jerzy hr. Mycielski, jezuita Jan Pawelski, gen. Tadeusz Rozwadowski, premier Jan Steczkowski, gen. Stanisław Szeptycki, minister dla Galicji Juliusz Twardowski, Alfred Wysocki.

During queries conducted in 2018 in the State Archive in Vienna, the author has created a record of polonica in the War Archives (Kriegsarchiv), in the fond of Army High Command (Armeeoberkommando – AOK), in sub-collection Corps of Quartermasters (Quartiermeisterabteilung - Qu.Abt.). Eight boxes were searched (No. 2514–2521), containing documents dated 1918; numerous polonica were found. Recorded materials pertain to the matters of Polish military and statehood, k.u.k military administration in Polish territories, emerging Ukrainian statehood. Documents contain the names of distinguished persons: regents Aleksander Kakowski, Zdzisław Lubomirski and Józef Ostrowski, Bishop Ignacy Dubowski, Austro-Hungarian Minister of Foreign Affairs Ottokar Czernin, General Jan Dowbor-Muśnicki, General Franciszek Kleeberg, Stanisław Kot, Jan Konopka, Prime Minister Jędrzej Moraczewski, Count Jerzy Mycielski, Jesuit Jan Pawelski, Genreral Tadeusz Rozwadowski, Prime Minister Jan Steczkowski, General Stanisław Szeptycki, Minister for Galicia Juliusz Twardowski, Alfred Wysocki.
