Artykuł stanowi próbę porównawczej analizy dwóch instytucji opartych na prawie zwyczajowym, a służących do rozwiązywania konfliktów klanowych – albańskiej mediacji zwyczajowej opartej na Kanunie oraz przed-Islamskiej procedury Sulha, wciąż żywej na terenach Palestyny i Izraela. Analiza prowadzona jest w kontekście różnic i podobieństw instytucji prawa zwyczajowego oraz pochodzących z kultury Zachodu metod ADR (Alternative Dispute Resolutions). Skupia się na różnym rozumieniu przez ludzi pochodzących z różnych kultur (1) tak samo brzmiących terminów, (2) podobnie wyglądających procesów, (3) czy na pozór identycznych sytuacji. W toku artykułu przybliżona zostaje struktura obu instytucji, a także koncepty honoru, winy, pojednania, poufności, celowości postępowania oraz komunikacji. Wskazane zostają potencjalne zagrożenia, które mogą płynąć z braku wiedzy kulturowej.

The article aims to provide a comparative analysis of two institutions based on customary law which are used to solve a clan conflict – the Albanian customary mediation based on Kanun and the pre-Islamic procedure of Sulha, still present on the Palestinian and Israeli territory. The analysis is made in the context of differences and similarities between the above-mentioned customary law institutions and the ADR methods (Alternative Dispute Resolution) originating from the Western culture. The article notes the fact that people originating from various cultures understand differently (1)similar sounding terms, (2)similar processes and (3)outwardly identical situations. The article features an analysis of both the institution structures and the concepts of honor, guilt, reconciliation, confidentiality, the goals of procedures and communication. The potential threats which may emerge from the lack of cultural knowledge are noted.
