The verdict deals with a matter of a relationship between guilt and subjective side of a crime. The author of a comment criticizes the thesis that in a normative theory of a guilt the possibility of prescribing a proper kind of a subjective side of a crime does not influence a guilt. A doctor guarantees that a fatal effect does not appear. The law demands that he/she must behave with respect to rules of safety.

Wyrok dotyczy kwestii wzajemnej relacji winy oraz strony podmiotowej. Autorka glosy krytycznie odnosi się do stwierdzenia, że w teorii normatywnej winy możliwość przypisania odpowiedniej postaci strony podmiotowej nie ma wpływu na przypisanie winy. Lekarz jest gwarantem nienastąpienia skutku w postaci śmierci pacjenta. Wymaga się od niego zachowania ostrożnego w danych okolicznościach.
