A special area of the interest of the Supreme Audit Office are issues of significant importance to the safety of the state. NIK has been successively auditing the elements of this system and solutions aimed at preventing and counteracting terrorism. These also include various units that use offensive measures with significant interference with the freedom and rights of persons, and that in case of necessity use weapon, also with a view to killing a person that commits a terrorist attack. The legislature refers to this case with the wording “special weapon usage”. The issue raises doubts as for the Constitution, especially regarding Article 38 that ensures the right to life. The article is an attempt to consider the selected issues related to the right not to be killed and its legal limitation (reduction) by the state due to a treat to safety or public order.

Szczególnym obszarem zainteresowania Najwyższej Izby Kontroli (dalej także NIK, Izba) są kwestie mające zasadnicze znaczenie dla bezpieczeństwa państwa. NIK sukcesywnie przeprowadza kontrole elementów jego systemu oraz rozwiązań ułatwiających przeciwdziałanie terroryzmowi i zwalczanie tego zjawiska1 . Obejmują one również różnego rodzaju formacje stosujące działania ofensywne, charakteryzujące się daleko idącą ingerencją w wolności i prawa jednostki, a w razie konieczności mające możliwość użycia broni, również w celu pozbawienia życia osoby dokonującej zamachu terrorystycznego. Ustawodawca określił to terminem „specjalne użycie broni”. Zagadnienie budzi wątpliwości konstytucyjne, zwłaszcza w odniesieniu do art. 38 ustawy zasadniczej, w którym zagwarantowano prawną ochronę życia. Rozważania podjęte w artykule odnoszą się do wybranych zagadnień dotyczących zakazu pozbawienia życia (ang. right not to be killed2 , tj. prawa do nie bycia zabitym) oraz jego legalnej limitacji (ograniczenia) przez państwo ze względu na zagrożenia bezpieczeństwa lub porządku publicznego.
