Principle of accusatorial procedure states that criminal proceedings should be conducted only upon the request of a party and thus, the court cannot take the initiative. By the Act of 11 March 2016 the courts’ right to demand supplementing preparatory proceeding during preliminary verification of indictment has been brought back to the criminal procedure. The possibility of adjourning or defer- ring the trial in order to demand additional evidence has also been restored. The aim of the paper is to consider how these court powers affect the principle of accusatorial procedure and to answer the question whether departure from this principle is justified, for example, by the need to comply with other principles of criminal proceedings.

Komentarz dotyczy wyroku Trybunału Konstytucyjnego z 11 stycznia 2024 r., w którym Trybunał dokonał samoistnej kontroli i uznania za niekonstytucyjny przepisu ustawy o Trybunale Stanu z powodu szczególnej wykładni pominięcia prawodawczego. W tekście wskazane są zarzuty wobec takiego rozstrzygnięcia oraz zarysowane konsekwencje tego rodzaju odstępstwa od zasady skargowości.

The commentary concerns the judgment of the Constitutional Tribunal of January 11, 2024, in which the Tribunal performed a self-consistent review and declared as unconstitutional a provision of the Law on the State Tribunal due to a particular interpretation of a legislative omission. The text indicates the objections to such a ruling and outlines the consequences of such a departure from the principle of accusatorial procedure.
