The article aims to outline and sort out practical, but not sufficiently recognized by the doctrine of law and jurisprudence, issues of the security for claim by suspending the effectiveness (enforceability) of the company general meetings’ resolutions that are contested under the provisions of the Code of Commercial Partnerships and Companies. The considerations include the nature of this way of securing, terminological issues as well as its conditions and admissibility depending on the legal character and subject of the resolution and time when the security is granted. The analysis leads to the conclusion that, contrary to the liberal attitude of the judicature, not all resolutions and not in all circumstances undergo the security for claim consisting in the suspension of their effectiveness.
