The study deals with the polity characteristics of the post of the Head of Customs and Tax Office. As a result of the research it turned out that the position is one of public authority, yet with the character which is not connected with entitlements of the police type. On the other hand, as regards the procedural layer, this official’s activity is characterized by a relative transfer operation of proceedings to the second instance. Taking the current practice into consideration, the establishment of such a body seems to have been justified.

Artykuł analizuje postanowienia ustawy o przeciwdziałaniu nieuczciwemu wykorzystaniu przewagi kontraktowej z perspektywy instytucjonalnej. Artykuł zawiera zestawienie argumentów przemawiających za tym, że przyjęte przez ustawodawcę rozwiązanie, polegające na przydzieleniu Prezesowi UOKiK roli organu odpowiedzialnego za wdrażanie ustawy, należy uznać za całkowicie chybione. Punktem odniesienia dla prowadzonych rozważań są postanowienia ustawy o ochronie konkurencji i konsumentów. Autorka postuluje powierzenie kompetencji do przeciwdziałania nieuczciwemu wykorzystaniu przewagi kontraktowej wyspecjalizowanemu organowi administracji sektora rolnego.

The article provides an analysis of the provisions of the Act on Counteracting Unfair Use of Superior Bargaining Power from an institutional perspective. A set of arguments is presented supporting the view of the incorrectness of the provision whereby the UOKiK President is responsible for the implementation of this Act. The rules of the Act on Competition and Consumer Protection provide a point of reference for the analysis contained in this article. The author stipulates that competences with respect to counteracting the unfair use of superior bargaining power should be transferred from the UOKiK President to a specialized administrative body in the agricultural sector.

The deliberations in this article concentrate on the issue of the legal character of obligatory contributions to the guarantee funds of banks and credit unions. The article explains the reason and the purpose of establishing the deposit guarantee scheme for banks and credit unions. Moreover, an attempt has been made to define the legal status of Bank Guarantee Fund and to explain the character of the legal acts – resolutions – issued by the Fund Council with regard to the amount of contributions to the guarantee fund of banks and credit unions. The said resolutions of the Fund Council on each occasion materialize the obligation of banks and credit unions to pay the contribution on the terms and conditions set therein.

Rozważania przedstawione w artykule skupiają się na problematyce charakteru prawnego obowiązkowej składki na fundusz gwarancyjny banków oraz kas. Z racji tego w artykule wyjaśniono istotę i cel tworzenia systemu gwarantowania depozytów dla banków i kas. Podjęto również próbę określenia statusu prawnego Bankowego Funduszu Gwarancyjnego oraz wyjaśnienia charakteru aktów – uchwał – wydawanych przez Radę tego Funduszu w przedmiocie określenia wysokości składek na fundusz gwarancyjny banków oraz kas. Rzeczone uchwały Rady Funduszu każdorazowo materializują bowiem obowiązek regulowania składek przez banki i kasy na zasadach tam oznaczonych.
