The purpose of this article is to present the institution of administrative procedural law, the administrative settlement, regulated under Chapter 8 of the Administrative Procedure Code (APC). The conditions of admissibility of the settlement, the mode of its preparation, inspection and approval have been discussed. In context of the introduced classification of procedural facts, there have been made a detailed procedural analysis of procedural actions of the parties and administration authority in the procedure of conclusion, preparation and approval of the settlement. In relation to the views of doctrine and jurisprudence the author examines the normative construction of settlement in the APC. The view prevailing in the doctrine considers administrative settlement as an agreement concluded by the parties and approved by the administration authority (so-called binary construction of administrative settlement). Recognizing this view as erroneous the author shows that, from the procedural point of view, the settlement is constituted solely by the agreement concluded by the parties, prepared by the administration authority and signed by an authorized officer of the administration authority and by the parties. Defined in such way, the administrative settlement is a non-imperial legal form of action of administration- the actual action consisting of preparing the settlement and signing it by an authorized officer. Unapproved administrative settlement has the procedural effects such as the obligation of inspection and obligation to issue a resolution on its approval (refusal of approval). Approval (refusal of approval) of the administrative settlement, in the form of resolution, is a separate legal form of action of administration, the unilateral imperial declaration of will, the administrative act.

The focal point of this paper is an analysis of instances of regulations that prescribe the variability (interchangeability) of legal forms of public administration’s actions. Therefore, it is a matter of special (if only because rarely occurring) cases, in which the multiformity of public administration’s activity results from the consent to accept alternative administration. The author’s intention is to present a multifaceted contemporary public administration in terms of indication and description of legal institutions, within which the legislator has introduced the possibility of choosing different forms of action by the authority, such as: the ability to issue a regulation, order or decision by the relevant authority if it proves necessary to restrict freedom and rights during the state of natural disaster, the exchangeability of an administrative decision and the administrative settlement and alternative use of administrative silence. The considerations concern the legal forms of actions on the part of public administration, because (for them) interchangeability of the forms of public administration’s actions is extremely rare and incidental, while looking at the actual (non-legal) forms of public administration allows seeing greater acceptance of the alternative behavior in the analyzed context. The reflections are supported by an attempt to answer questions about the reasons, variants and consequences of building legal regulations in a way that allows the legal forms of public administration’s action to change.

The study has been devoted to the issues of consensual forms of administrative-legal actions replacing or supplementing administrative decisions. The first part of considerations deals with the consensual forms which are the alternative legal forms of disposing of the administrative matters. The alternativity of these forms lies in the choice of the legal form of administrative matter disposing, the priority of using the consensual form and the subsidiarity of the administrative decision or in the legal possibility of replacing (substitution) the already issued decision with the consensual form. The second part of the analysis was focused on the normative solutions establishing the competence bases for the complementing or even concretizing of the administrative decision content by means of the consensual forms of the administrative authorities and private entities actions.

Opracowanie zostało poświęcone problematyce konsensualnych form działań organów administracji publicznej lub podmiotów prywatnych, które zastępują lub uzupełniają decyzje administracyjne. W pierwszej części rozważań analizie poddano konsensualne formy działań administracyjnoprawnych stanowiących alternatywne formy prawne załatwiania spraw administracyjnych. Alternatywność tego rodzaju form polega na możliwości wyboru formy prawnej załatwienia sprawy administracyjnej, pierwszeństwie użycia formy konsensualnej i subsydiarności decyzji administracyjnej albo możliwości zastąpienia (substytucji) już wydanej decyzji administracyjnej przez określony typ formy konsensualnej. W części drugiej analizy omówiono i poddano teoretycznej ocenie rozwiązania normatywne ustanawiające podstawy kompetencyjne do uzupełniania lub nawet konkretyzowania treści decyzji administracyjnych za pośrednictwem uprzednich lub następczych konsensualnych form działania organów administracji publicznej oraz podmiotów spoza systemu administracji publicznej.

In cases where possible, public administration bodies strive for an amicable settlement of disputes and to establish the rights and obligations that are the subject of the proceedings. The purpose of this study is to present the issues related to the amicable settlement of cases in administrative proceedings, taking into account the role of the authority in the pursuit of an amicable settlement of disputes and the amicable settlement of the rights and obligations of the parties to the proceedings being the subject of administrative proceedings. The principle of an amicable settlement of cases is specified in particular by two procedural institutions – the administrative settlement and mediation.

Organy administracji publicznej w sprawach, których charakter na to pozwala, dążą do polubownego rozstrzygnięcia kwestii spornych oraz ustalenia praw i obowiązków będących przedmiotem postępowania. Celem niniejszego opracowania jest przedstawienie problematyki związanej z polubownym załatwieniem spraw w postępowaniu administracyjnym z uwzględnieniem roli organu w dążeniu do polubownego rozstrzygania kwestii spornych oraz do polubownego ustalania praw i obowiązków stron postępowania będących przedmiotem postępowania administracyjnego. Zasadę polubownego załatwiania spraw konkretyzują w szczególności dwie instytucje procesowe – ugoda administracyjna i mediacja.
