Soviet’s Legal Heritage Role in the Development of Ukrainian Law

The formation of soviet law in Ukraine was inevitably connected with the spread of soviet power. Along with the soviet institutions, legislative acts of Soviet Union were spread on the territory of Ukraine and replaced the earlier normative acts. The legal system in Ukraine was in fact formed on the basis of the ideological foundations created by the Soviet Union. However, it is a fact that the system of law in Russia after the October Revolution of 1917 did not emerge from scratch, but was built on already existing legal traditions. They are based on three basic sources: German legal tradition, which influenced pre-revolutionary Russian legal culture, Russia’s own legal culture and, of course, official socialist ideology, as well, which provided the legal system with a link to the legal past, which in turn ensured the advancement of the legal system. The legal development of Ukraine during the soviet period was based on the adapting of Ukrainian legal past to the needs of the soviet period. Accordingly, this approach confirms the preservation of the link between the Ukrainian legal past and the present. That means, that the processes that are happening nowadays in the legal system of the modern Ukraine cannot be analyzed without taking into account the initial state of legal institutions that were formed Before and After the soviet period. Therefore, the preservation and analysis of the Ukrainian SSR’s law as a legal heritage of Ukraine will make it possible to ensure progress in the evolution of the modern Ukrainian legal system.

The subject of this article comprises the experiences of representatives of the Polish peasant strata who, in the first post-war years, became politically active as party activists or state officials. The main thesis of the paper is that the pre-war Polish communist movement and post-war structures of power constitute a space of simultaneous overlapping and tensions between people’s history and political history. The personal files of working-class and peasant activists may be regarded as source material for the above. In this article, the author indicates the benefits that historians and sociologists can draw from an in-depth and empathetic analysis of this source base, revealing patterns of political socialisation, the dynamics of biographical transformations and their perception, the status uncertainty of “former labourers” and “former peasants”, the horizons of their aspirations and their claims to agency and its political limitations.

Tematem tego artykułu są doświadczenia przedstawicieli i przedstawicielek polskich warstw ludowych, którzy w pierwszych latach powojennych weszli w pole czynnego zaangażowania politycznego jako działacze partyjni czy funkcjonariusze państwowi. Główną tezą tekstu jest stwierdzenie, że przedwojenny polski ruch komunistyczny i powojenne struktury władzy stanowią przestrzeń jednocześnie zachodzenia na siebie oraz napięć pomiędzy między historią ludową oraz historią polityczną,. W wymiarze źródłowym taką rolę spełniać mogą zaś akta osobowe działaczy i działaczek pochodzenia robotniczego i chłopskiego. W tekście sygnalizuję korzyści jakie historycy i socjologowie wynieść mogą z pogłębionej i empatycznej analizy tej bazy źródłowej, ukazującej wzorce socjalizacji politycznej, dynamikę biograficznych transformacji oraz ich postrzegania, statusową niepewność „byłych robotników” i „byłych chłopów”, horyzonty ich aspiracji oraz roszczenia do sprawczości i jej polityczne ograniczenia.

Latynoamerykanie w Stanach Zjednoczonych są przedstawiani jako ubodzy i niewykształceni imigranci stanowiący zagrożenie dla pozostałych członków społeczeństwa. Niemniej jednak przedstawiciele tej mniejszości w ostatnich czasach stają się konsumentami przynoszącymi coraz większe zyski, a także wyborcami, z którymi muszą liczyć się politycy. Fakty te mogą wskazywać na awans społeczny i ekonomiczny tej grupy. Badacze zajmujący się zagadnieniem emigracji z krajów Ameryki Łacińskiej do Stanów Zjednoczonych określają wspomniane zjawisko mianem „latynoamerykańskiego paradoksu”. Arlene Davila w swojej książce Latino Spin: Public Image and the Whitewashing of Race przedstawia jego szczegółową analizę. Niniejszy artykuł jest próbą omówienia głównych kwestii dotyczących wspomnianego „latynoamerykańskiego paradoksu”. Obejmują one postrzeganie Latynoamerykanów w USA, ich wizerunek wykreowany przez instytucje, specjalistów od marketingu i media. Omawiane problemy odnoszą się do aspektów nadawania rasy, obywatelstwa, wyboru tożsamości, relacji z Afroamerykanami, statusu społecznego i klasy w kontekście awansu ekonomicznego i potencjału tej mniejszości jako konsumentów.

Latin Americans in the United States are generally presented as a group of poor and uneducated immigrants that pose threat to other members of society. Yet, representatives of this minority recently have become profitable consumers and influential voters, which may indicate social and economic advancement. Thus researchers dealing with the issues of Latino integration in the U.S. define this phenomenon as Latino paradox. Arlene Davila in her book Latino Spin: Public Image and the Whitewashing of Race presents its detailed analysis. This article is an attempt to discuss the main issues pertinent to Latino paradox. They encompass aspects of Latino perception in the Unites States and their image created by institutions, marketers and the media. The discussed problems cover, among others, racialization, citizenship and identity choices, relations with African Americans, social status and class in relation to economic advancement and the potential of this minority as consumers.
