Doświadczenia zgromadzone przez resort rolnictwa w zakresie rolnych postępowań administracyjnych wskazują, że nadal istnieją braki w sferze regulacji i rozpatrywania spraw w ramach tych postępowań. Dlatego celem rozważań jest scharakteryzowanie rolnych procedur administracyjnych oraz uzasadnienie potrzeby ich modernizacji zgodnie z regulacjami naszej Magna Carty i prawa postępowania administracyjnego. W konkluzjach autorki stwierdzają między innymi, że procesy administracyjne przewidziane do rozstrzygania spraw rolnych nie są najbardziej efektywne, ponieważ wrażliwa społecznie istota spraw rolnych wymaga sprawnych i skutecznych mechanizmów, które powodowałyby jak najmniejsze szkody dla zainteresowanych i dla majątku będącego przedmiotem sporu. Reforma postępowania w sprawach rolnych powinna opierać się na niezbędnej modernizacji obecnych procedur administracyjnych, opracowaniu takiego modelu postępowania rolnego, który zapewniłby większą szybkość postępowania i ustanowieniu izby lub sekcje rolnych w sądach ludowych.

The experience which the Ministry of Agriculture has gained regarding agricultural administrative proceedings shows that within the existing procedures there are still certain deficiencies in the regulation and the handling of cases. The aim of this article is to present them and justify the need for their modernisation in accordance with the regulations of the Cuban Magna Carta and the law of administrative proceedings. It is further claimed the current procedures do not ensure efficient solutions as the socially sensitive nature of agricultural issues requires particularly reliable and effective mechanisms that would also cause the least possible damage to those concerned and to the property in dispute. Therefore the reform should focus on the necessary modernisation of the current procedures and the development of a model that would ensure a greater speed of agricultural proceedings. This will also require the establishment of an agricultural chamber or designation of special purpose sections in People’s Courts.

La experiencia acumulada en la tramitación de los procedimientos administrativos agrarios a cargo del Ministerio de la Agricultura, incluso después de haberse introducido algunos cambios en las normas procesales orientados a la actualización, simplificación y unificación del procedimiento administrativo agrario, demuestra que todavía existen deficiencias en la regulación y tramitación de los mismos. De igual manera, en el ámbito procesal aún existe carencia de normas a las cuales recurrir para la solución de algunas controversias de carácter agrario, así como, en el orden sustantivo, una multiplicidad de disposiciones administrativas que producen confusión y dan por resultado insatisfacción y falta de credibilidad. El presente artículo tiene como objetivo caracterizar estos procedimientos administrativos agrarios y la necesidad de su modernización de acuerdo con las regulaciones de nuestra Carta Magna y la Ley del Proceso Administrativo, en función de concebir un debido proceso y procedimiento administrativo agrario, para enfrentar la problemática que se deriva del tratamiento de los conflictos relacionados con la posesión y uso de la tierra.
