The Enhancement of Immovable Cultural Heritage by Urban Planning Law: The French Experience

Despite the incremental development of the heritage dimension of local urban planning plans, as well as an ever-more substantial relationship between immovable cultural heritage law and urban planning law, these two elements remain susceptible to raising confusion, occasionally contradicting one another frontally. The French Act of 7 July 2016 on Freedom of Creation, Architecture, and Heritage had the initial ambition of harmonizing and simplifying the mechanisms for the protection and enhancement of immovable cultural heritage, including under urban planning law. Yet the Act of 23 November 2018 on Housing Development, Urban Planning, and Digital Technology has further contributed to weakening the heritage protection mechanisms and bestowed a priority on the construction of new buildings over the conservation and enhancement of old neighbourhoods and buildings.

Badania terenowe budynków oddanych do użytku są prowadzone zarówno w Wielkiej Brytanii, jak i Polsce. Te, których wyniki mają szersze zastosowanie, wykraczające poza analizowane obiekty, są tematem tego numeru „Architectusa”, któremu przyświecają dwa główne cele. Pierwszym jest prezentacja praktyki badawczej różnych dyscyplin naukowych w odniesieniu do badań empirycznych budynków lub przestrzeni zurbanizowanych w Polsce. Drugim jest rozpoczęcie dyskusji nad możliwościami wprowadzenia w Polsce metody oceny funkcjonowania budynków (ang. Building Performance Evaluation – BPE), rozwijanej w Wielkiej Brytanii w oparciu o badania terenowe prowadzone tam od kilku dekad. W niniejszym artykule wskazano szerszy kontekst uzasadniający wprowadzanie zagadnień z zakresu BPE do warunków polskiego budownictwa. Zarysowano podobieństwa i rozbieżności w aktualnej praktyce prowadzenia badań w każdym z krajów. Sformułowano też kluczowe zalecenia dotyczące przyszłych badań i działań koniecznych dla rozwoju w Polsce warunków do prowadzenia badań BPE.

Field studies in already commissioned and occupied buildings are common both in the UK and Poland. Those generating knowledge applicable beyond the studied buildings are the focus of thematic issue of “Architectus” with two major objectives in mind. Firstly the aim is to showcase current research practice and expertise of various academic disciplines in relation to conducting empirical studies in occupied buildings or urban spaces in Poland. Secondly the issue aims to initiate a discussion on the potential to implement in Poland a building performance evaluation (BPE) approach developed in the UK and based on field studies in buildings over recent decades. This paper provides the necessary background for introducing the subject of BPE into the Polish context. It also offers an overview of similarities and discrepancies in state-of the art research practices in each country. Key recommendations for future research and actions needed to facilitate emergence of BPE focused community of practice are identified.
