This solution is an electrical solution that is used by the bankruptcy trustee. A trustee is a solution to keep a bankrupt entreprise intact. The trustee conducts general enforcement of the bankrupt’s debt to the highest possible satisfaction. However, it is not possible to allow in advance the admissibility of functional activities that meet the criteria of economic desirability. Because the ambition of this article is to solve a certain problem there is a proposal of the testing institution to justify the advisability of the device by the functional trustee. Such a test should be used to exclude doubts about the performance of activities during bankruptcy proceedings. The leading one is compliance with economic expediency.

Przedmiotem niniejszego opracowania jest zagadnienie czynności inwestycyjnych dokonywanych przez syndyka masy upadłości. Syndyk jest zobowiązany do zachowania przedsiębiorstwa upadłego w stanie niepogorszonym. Syndyk prowadzi egzekucję generalną z majątku upadłego celem jak najbardziej efektywnego zaspokojenia wierzycieli. Nie można jednak z góry wykluczyć dopuszczalności czynności inwestycyjnej syndyka, jeżeli spełnia ona obiektywne kryteria celowości ekonomicznej. W związku z tym, że ambicją tego artykułu jest rozwiązanie pewnego problemu prawnego, zaproponowana została instytucja testu inwestycyjnego, aby uzasadnić celowość dokonywania przez syndyka czynności inwestycyjnych. Test taki powinien być przygotowany, aby uniknąć wątpliwości co do potrzeby dokonania czynności inwestycyjnej w toku postępowania upadłościowego. Wiodącym kryterium jest kryterium celowości ekonomicznej.
