The Gross Injustice and the Gross Infringement of Law

The state of gross injustice obliges the appeal court to repeal the sentence irrespecitive of the complaint boundaries and the raised complaints. The gross infrigement of law is one of the cassation bases. The article presents the designations of these terms and the interdependence between them.

Stan rażącej niesprawiedliwości orzeczenia obliguje sąd odwoławczy do uchylenia rozstrzygnięcia niezależnie od granic zaskarżenia i podniesionych zarzutów. Rażące naruszenie prawa stanowi natomiast jedną z podstaw kasacyjnych. Artykuł jest próbą odnalezienia desygnatów powyższych terminów i wskazania zależności pomiędzy analizowanymi pojęciami.
