The subject of this article is an attempt to verify whether the opinions found in the doctrine and judicature allow a given act which takes the form of a boycott to be clearly classified as a manifestation of unfair competition. This is particularly important in view of the fact that the legal boundary between the so-called permitted dissemination of certain information about a given entrepreneur and the prohibited incitement is difficult to determine. A separate issue in this area is to specify whether hindering market access and the associated phenomenon of torpedoing business activity must always bear the characteristics of an act of unfair competition, and in particular a boycott.

Przedmiotem niniejszego artykułu jest próba weryfikacji, czy zastane w doktrynie i judykaturze opinie pozwalają jednoznacznie zakwalifikować dany czyn jako przejaw nieuczciwej konkurencji, który przybiera formę bojkotu. Jest to szczególnie istotne, biorąc pod uwagę fakt, że granica prawna pomiędzy tzw. dozwolonym rozpowszechnianiem określonych informacji o danym przedsiębiorcy a zakazanym nakłanianiem nie jest łatwa do ustalenia. Odrębnym zagadnieniem pozostaje ustalenie w tym obszarze, czy utrudnianie dostępu do rynku i związane z tym zjawisko torpedowania prowadzonej działalności gospodarczej zawsze musza nosić znamiona czynu nieuczciwej konkurencji, a w tym w szczególności bojkotu.

This study examines written sources documenting Polish travels to German resorts from the the mid-19th century until the outbreak of World War I. The topic at hand encompasses multiple disciplines, including literary history and cultural anthropology. Among the resorts popular among Poles in the 19th century, Baden-Baden emerges as the most prominent German spa town which attracted the then elite of Europe. It gained its reputation due to the beneficial climate and hot springs as well as a diverse array of recreational activities. As the political situation deteriorated (the Kulturkampf, Prussian restrictions), Polish trips to German resorts came to be viewed in a political context. As a result, a campaign for boycotting „the baths” was launched in the Polish press. Written sources documenting Polish travels to German and Prussian resorts from the 19th and early 20th centuries provide insight into the historical context of the period, and offer a unique perspective on various political, economic, and social issues.
