This paper outlines legal considerations connected with the concept of a “buffer zone” presented on the basis of Polish and foreign legislation, theory and practice. The statutory regulation of a “buffer zone” is laconic and therefore it is necessary to interpret it basing on the doctrine in order to avoid problems with its practical application by administrative bodies and judicial authorities. The paper contains different understandings of the concept of a buffer zone defined in law and in literature. And yet, buffer zones fulfill many important functions and therefore an analysis of their constitutive features seems to be necessary for correct making and application of the law. Foreign examples presented in the paper illustrate the universality of the issue. Based on legislative texts, the doctrine and judicial decisions as well as other legal acts regulating land use and spatial planning, an attempt is then made to present the impact of a buffer zone on the functioning of the areas in its neighbourhood. Further, the current lines of case law of administrative courts with respect to the issue of a buffer zone are shown, followed by a proposal to amend the statutory definition of a buffer zone. References to non-legal considerations regarding the issue in Polish and foreign literature have also been included to ensure a more holistic approach to the subject, since its full understanding requires taking into account the reasons for which a buffer zone has been established, and the functions it has to fulfill in nature conservation. Legal regulations governing buffer zones reflect environmental concerns and other related issues covered by widely understood ecology and cannot be only discussed from the legal point of view.

Opracowanie ukazuje kwestię prawną otuliny na podstawie polskiego i zagranicznego dorobku naukowego. W związku z lakonicznością przepisów normujących to zagadnienie niezbędna jest refleksja doktryny, dzięki której możliwe do uniknięcia będą problemy praktycznego stosowania uregulowań przez organy administracyjne oraz sądowe. Autor rozpatruje rozumienie pojęcia otuliny określone przez właściwe przepisy, a także porównuje je z dorobkiem zawartym w literaturze przedmiotu. Otulina pełni wiele istotnych funkcji, dlatego analiza jej konstytutywnych cech wydaje się niezbędna dla prawidłowego stanowienia oraz stosowania prawa. W pierwszej kolejności artykuł odnosi się do światowego dorobku naukowego oraz przytacza dane ukazujące powszechność zagadnienia. Ze względu na ponadkrajowy charakter omawianej materii oraz liczbę zagranicznych publikacji niezbędne jest ich skrótowe przywołanie. Następnie zostaje podjęta próba ukazania wpływu ustanowienia obszaru otuliny na funkcjonowanie tego obszaru. Rozpatrując tę kwestię, autor opiera się na tekstach ustaw, stanowisku doktryny i judykatury, a ponadto uwzględnia inne akty prawne regulujące zagospodarowanie przestrzenne oraz korzystanie z nieruchomości. Dalej ukazuje także bieżącą linię orzecznictwa sądownictwa administracyjnego w odniesieniu do problematyki otuliny oraz propozycję zmiany definicji ustawowej omawianego pojęcia. Opracowanie zawiera także odesłania do analiz pozaprawnych autorów polskich i zagranicznych, co pozwala na holistyczne ukazanie poruszanego tematu. Dla pełnego zrozumienia zagadnienia otuliny konieczne jest uwzględnienie celu jej ustanowienia oraz funkcji, jakie ma pełnić w ochronie przyrody, w związku z czym dogłębne rozważania nie mogą uwzględniać tylko aspektów prawnych, ponieważ te stanowią odbicie treści poruszanych przez szeroko rozumianą ekologię.

Turkey’s Security Dilemma on the Border with Syria: Situation Assessment and Perspectives of the Intervention

Employing the concept of the security dilemma, the article aims to assess the situation on the Turkey-Syria border and discusses perspectives of Turkey’s humanitarian intervention in northern Syria. In the first section of the article an analysis of Turkey’s foreign policy and its implications on Syria’s crisis is provided. The second section deals with arguments for and against the intervention. Later on, international law and military provisions are discussed as well as the possible implications of an intervention. The main thesis of this article is that if Turkey chose to solve its security dilemma by means of a humanitarian intervention, the UN Security Council’s approval would greatly enhance the chances of its success. Otherwise, unilateral intervention could even further diminish the possibility of finding a faster solution to the Syrian crisis and regional peace and stability in general.

W niniejszym artykule zaprezentowano metodę umożliwiającą ocenę komfortu termicznego w pomieszczeniach funkcjonujących jako termiczne strefy buforowe. Zaproponowano scenariusz gry oraz prototyp pozwalający na symulowanie zmian warunków termicznych w budynku, zachodzących pod wpływem informacji wprowadzanych do modelu przez gracza. Zaprojektowany algorytm umożliwia różne działania gracza, takie jak definiowanie kształtu i wielkości budynku, ustawianie jednego bądź wielu graczy, dla których budynek musiałby być zoptymalizowany pod kątem różnych potrzeb, a także określanie aktywności fizycznej wpływającej na metabolizm mieszkańca – tym samym na odczuwanie przez niego temperatury. Pozwala on również na prowadzenie symulacji różnych pór dnia i roku. Symulacje w programie Design Builder Energy Plus prowadzone na prototypowym modelu budynku skupiają się na zmianach czasu, przestrzeni oraz energii w teoretycznym budynku, zlokalizowanym we Wrocławiu. Ich głównym celem było określenie najlepszych ustawień dla strefy buforowej, tak aby możliwe było przebywanie w niej w najcieplejsze i najchłodniejsze dni w roku bez potrzeby dodatkowego chłodzenia czy ogrzewania tego pomieszczenia. W artykule przedstawiono proponowane ulepszenia dla strefy oraz kryteria oceny komfortu termicznego i zadowolenia użytkowników pomieszczenia.

This article presents a methodology for assessing thermal comfort in building’s adjacent spaces, which may function as buffer zones. The game scenario and prototype model were proposed as the result of the research project. This prototype allows conducting simulations of the changes introduced by the player to the building’s model and consequences in the building’s thermal conditions. The created game algorithm includes the player’s actions, such as defining geometry, volume and openings in the building’s model; setting preferences (one or a multi player, members of the family) and describing the activity (metabolic rate). The algorithm also includes loops with additional changes, namely time of day and seasons, construction and insulation materials, small heat gains sources, virtual partitions, etc. Prototype analyses, conducted in Design Builder Energy Plus program, were focused on altering time, material, spatial, and energy settings in a theoretical building, located in Wrocław. The main aim of these simulations was to define best settings for the buffer zone, so that it will be possible to spend time there in the hottest week in summer and the coldest in winter. The project description also includes projected improvements and evaluation criteria for satisfying thermal comfort and happiness of the inhabitants.
