The issue of the location of economic entities, which is crucial for economic geography, is becoming the object of ever more thorough analyses undertaken by the growing number of various academic disciplines, and especially those included in economic sciences, which paradoxically initiated this trend of research. This results from the cognitive interests of these disciplines, but also the needs of economic practice related to the perception of the complexity of conditions and the implications of the location of economic entities and its significance for their competitiveness. Each of the disciplines studying this issue does it a bit differently, and the analyses they make are a function of the academic identity of the researchers who conduct them. It is institutionally conditioned and determined by their education and practical experience, while the dynamically treated location theory plays a crucial role in its formation. However, the question remains whether the academic identity of the researchers of the location of economic entities shaped around this theory should be complex, nomadic or explicitly defined, and how the postulate of interdisciplinary investigation of location issues should be understood in this context.

Life long learning, apart from obvious benefits in the form of better employability prospects, permanent widening of competences and skills related to higher earnings, also enables avoiding different types of exclusion – including digital exclusion causing that the competitiveness of labour force is reduced and thus it limits the participation in economic processes. In the broader aspect, an education of the society is a key to the strong economy, based on the knowledge and innovations. Therefore, the propensity of the labour force to participate in life long learning as well as supporting this process by institutions (and employers) are extremely important. The main goal of the paper is to present the findings of conducted research study in the area diagnosis of educational activity of employees and to define main barriers which limit participation in life long learning schemes. The analysis is based on opinions stated by employers, employees and representatives of various institutions, employees’ and employers’ organizations, within IDI and FGI interviews.

Kształcenie przez całe życie, oprócz oczywistych korzyści w postaci większych szans na rynku pracy, stałego poszerzania kompetencji oraz umiejętności i związanych z tym wyższych zarobków, daje również szanse na uniknięcie różnych rodzajów wykluczenia sprawiającego, że pozycja konkurencyjna zasobów pracy jest niższa i ogranicza uczestnictwo w procesach gospodarowania. W szerszym aspekcie edukacja społeczeństwa to klucz do silnej gospodarki, opartej na wiedzy i innowacjach. Dlatego też niezwykle ważna jest zarówno skłonność zasobów pracy do podejmowania kształcenia przez całe życie, jak również wspieranie tego procesu przez instytucje, a przede wszystkim podmioty gospodarcze. Celem artykułu jest przede wszystkim prezentacja wyników przeprowadzonych badań w zakresie aktywności edukacyjnej pracowników oraz wskazanie głównych determinant takich działań. Podstawą przeprowadzonej analizy były wypowiedzi udzielone przez pracodawców, pracowników oraz przedstawicieli różnych instytucji i organizacji zrzeszających pracodawców i pracowników, udzielone w trakcie wywiadów IDI oraz FGI.

The article discusses concepts related to the legal definition of the key term in the Polish labour law system ‒ the concept of employer. The author presents the evolution of models and concepts for both individuals and organisational units acting as employers. The article addresses the issue of corporate links and the influence of such links on the definition of an employer, as well as the problems related to the qualification of a civil partnership.

W artykule omówiono koncepcje związane z definicją legalną kluczowego pojęcia w polskim systemie prawa pracy – pojęcia pracodawcy. Autorka przedstawia ewolucję modeli i koncepcji dotyczących zarówno osób fizycznych, jak i jednostek organizacyjnych występujących w roli pracodawcy. W artykule poruszona została kwestia powiązań korporacyjnych oraz wpływu tych powiązań na definicję pracodawcy, a także problemy związane z kwalifikacją spółki cywilnej.

W artykule przedstawiono wybrane przykłady rozwiązań normatywnych w zakresie identyfikacji barier i szans rozwoju konkurencyjności i innowacyjności. Prezentacja rozwiązań normatywnych została przedstawiona z uwzględnieniem skutków materialnoprawnych i procesowych. Analiza wybranych rozwiązań normatywnych wykazała istnienie związku między otoczeniem prawnym, w którym działa podmiot gospodarczy a innymi kategoriami środowiska biznesowego, tj. otoczeniem finansowym, ekonomicznym, etycznym, psychologicznym. W artkule opisano także alternatywne metody rozstrzygania sporów stanowiąc o konieczności edukacji prawnej.

In the article, the author presented some examples of normative solutions as regards identification of barriers and opportunities for development of competitiveness and innovativeness. The presentation of normative solutions was made taking into account substantive and procedural effects. An analysis of the selected normative solutions indicated the existence of the relationship between the legal environment, in which a business entity operates, and other categories of the business environment, i.e. the financial, economic, ethical, and psychological environment. In her article, the author also described alternative methods of dispute resolution indicating the need for legal education.
