The subject of the article is a new definition of a business lawsuit. It is regulated in the Code of Civil Procedure under the Act of 4 July 2019 which will enter into force 3 months after its publication. The amendment reinstates the specific proceedings for a business lawsuit. In this context, of paramount importance is the definition of a business lawsuit, which sets the framework for these proceedings. The author compares the new definition to the previous one. He underlines that it has new elements which broaden the definition and may have negative influence on proceedings in such cases.

Przedmiotem niniejszego artykułu jest pojęcie sprawy gospodarczej w świetle nowelizacji Kodeksu postępowania cywilnego dokonanej na podstawie ustawy z 4.07.2019 r., która wejdzie życie trzy miesiące po jej opublikowaniu. Nowelizacja przywraca postępowanie odrębne w sprawach gospodarczych. W tym kontekście zasadnicze znaczenia ma definicja sprawy gospodarczej, która w znacznej mierze wyznacza ramy przedmiotowe tego postępowania. Autor porównuje nowe pojęcie sprawy gospodarczej do definicji dotychczas obowiązującej. Zwraca uwagę na nowe elementy tego pojęcia, które prowadzą do jego rozszerzenia, a w konsekwencji mogą negatywnie wpłynąć na procesy w sprawach gospodarczych.
