Regulacja przejścia zakładu pracy lub jego części na innego pracodawcę, zawarta w art. 231 Kodeksu pracy, nie zajmuje się problematyką skutków tegoż przejścia na zakładowy fundusz rehabilitacji osób niepełnosprawnych. W tym też zakresie konieczne jest sięgnięcie do ustawy o rehabilitacji zawodowej i społecznej oraz zatrudnianiu osób niepełnosprawnych. Zakładowy fundusz rehabilitacji osób niepełnosprawnych tworzony jest w zakładach pracy chronionej, które swój status uzyskują po spełnieniu określonych w powyżej wspomnianej ustawie kryteriów. Powstaje więc pytanie o wpływ przejścia zakładu pracy, a w szczególności jego części, na status zakładu pracy chronionej, a tym samym na zakładowy fundusz rehabilitacji osób niepełnosprawnych.

Regulation of transfers of undertaking, business or part of undertaking or business, contained in Art. 23 1 of the Labour Code does not address the issue of the impact of that transfer on company’s fund for rehabilitation of disabled persons. In this respect, it is necessary to refer to the Act of 27 August 1997 on the professional and social rehabilitation and employment of persons with disabilities. Company’s fund for rehabilitation of disabled persons is created in sheltered workshop, i.e. any business entity gaining such legal status upon fulfflling some criteria as specified in the above-mentioned Act. This paper focuses on the examination of the impact of the transfers of undertaking, business or parts of undertaking or business, on the status of a sheltered workshops, and thus the company’s fund for rehabilitation of disabled persons.
